I-130 approved, dazed and confused

Hi,

So I am pretty careful and went over all of the instructions for a K3 visa a while back. I sent the I-130 form in, and waited.

I got the notice of receipt, and then the notice of approval, then I looked at the instructions for what to do next. Then I

realized that I could have sent my I-129f application in when I got the notice of receipt for the I-130, about 3 months ago.

I sent the I-129f immediately. I have received a receipt for that. I am reading the documentation again, and came across this:

"The Second Step: Applying for a Visa

Important Notice: When both petitions have been approved by USCIS and sent to the NVC or when USCIS approves the I-130 before the I-129F, the availability of, as well as the need for, a nonimmigrant K-3 visa ends."

So now, honestly, I have no idea what this means. I looked at articles around the web, and they seemed to imply that after the I-130

gets approved, I don't need the I-129f anymore, that it goes to the embassy in my wife's home country without it. However, I have

received no notice whatever of that.

Any ideas?

So, I am reading, reading, reading the posts here, and what I get so far is:

1. Some folks just file a I-130 alone without the I-129f.

2. There seems to be a debate to the effect that filing a I-129f after a I-130 will actually slow down the process.

Well, for the second point I already did the I-129f, so too late for that.

However, I have a I-130 that was approved. So am I waiting to hear from the NVC? Or am I supposed to file other paperwork

now?

since your I-130 has been approved, once it gets to NVC , the 129 will be closed administratively when it arrives later and only your 130 will be processed.

wait a week or two after your approval date and start calling NVC to get your case number. meanwhile, start reading up the NVC short cuts here so you know how to prepare for that stage and be out as quickly as you possibly can.

10/12/2012: NOA 1
12/17/2012: NOA 2 (case was transferred to NYC office 11/27/12)
NVC stage ( 20 days)
01/08/2013: Case # and IIN assigned ( file arrived NVC mail room 12/20/12)
01/09/2013: AOS invoiced and paid, DS-3032 emailed and mailed.
01/16/2013: IV invoiced &paid. AOS & IV mailed in one package(arrived 01/18).

01/28/2013: Case complete!!!
04/19/2013: Interview; APPROVED!!!!!
05/13/2013: POE; JFK


N-400: (3 months and 12 days)
Filed N-400 : 2011-06-17
Interview: 2011-09-27
Oath Ceremony: 2011-09-30

IR-5 for Mom Entire process took 5 months exactly
USCIS (22days)

mailed I-130 : 2011-09-30
NOA 1: 2011-10-03 (text & email)
NOA 2: 2011-10-25 (text and email)
NVC: (19 days)
Case entered and # assigned: 2011-11-18
NVC Case COMPLETED: 2011-12-07 ( 43 days from NOA 2 and 65 days from NOA 1)
Interview Date(Lagos): 2012-01- 23
Mom was late for interview
New Interview date: 2012-02-29 : VISA APPROVED

many years ago you could file 1-130 and 1-129f at the same time as k-3,now that has changed if married already you just file 1-130 cr-1,and if single file for your fiancee 1-129f -k-1 visa.only

No that's not true. A person can still try to get a k3 visa like the OP did. But it's rare for it to go through.

You will follow the CR1 visa path now. There are posts that help with the NVC that I can't link on my phone atm, sorry. But they are located in the IR1/CR1 progress forum. Congrats on the approval. You will want to call the NVC until you can get your case numbers etc from them (both beneficiary and petitioner can call the NVC) so that you can pay the invoices, send in the choice of agent, AOS and IV application. :)

So I called NVC, they said they received it, but haven't done any more. 3 months is pretty good for a I-130

I take it. Does anyone know if after they process it, I can ask for an interview appointment with the embassy?

That is the thing that takes the longest, getting the next appointment.

OP, you have no timeline, and the visa type under your name (see left sidebar) says K-1. It will help others to help you in the future if you take care of these two items. :thumbs:

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
