Did any of you guyz did AOS from H-1b? If yes, then how long did it take? Was there an interview scheduled?

I started the process of adjusting from an H1-B in September, and also applied for AP and EAD since my H runs out at the end of the year. I've done biometrics but have not yet received an interview date or approval on the AP and EAD.

I assume I will have to go for an interview - unlike the lucky K visa folks!

I know a few people who have done so, family and employment based. I'm assuming you're doing family based. It's quite simple and can be done relatively quickly as long as you don't hit any bumps (like requests for evidence) As long as your H1 is good during the process you can continue to work and travel (since it is dual-intent) on it so you don't need an EAD or AP.

The averages are pretty much the same as anyone else filing family based, which ranges from anywhere between 3 and 6 months. This also depends on your local DO, and also on the dreaded name check, and of course, as mentioned before, requests for evidence. Despite what some people believe Status' don't really matter for determining the amount of time (though lately the people on K visas have been getting their green cards VERY quickly) so your H1 isn't going to be any quicker, but it won't neccessarily take any longer than somebody under another status/visa.

08/18/06 - RFE sent for Tax Return stuff, which was already sent with application

08/25/06 - RFE received by me in mail

09/05/06 - RFE returned to USCIS

09/11/06 - RFE Received by USCIS

10/31/06 - InfoPass to check status on 485 and 765 - Apparently a push has been made on 765

11/06/06 - I-765 (EAD) Approved!

11/13/06 - Received EAD, Approval notice mailed for I-765?

11/20/06 - Receive Interview Letter

11/29/06 - TN Expired

01/04/07 - Interview! - APPROVED!!!!

01/22/07 - InfoPass Appt: Got I-551 stamp in passport

01/24/07 - I-485/I-130 Approval E-mails / Welcome notice sent

My I-130 and I-129F were both applied respectively but I moved to US from Canada on an H-1b on the 20th of last month. Since I am here now and really don't wanna go to Canada to get my CR-1 or K-3.. I want to apply for AOS... I also want to apply for EAD because that would enable me to search for a better job with better payscales. I have already gone through the security check / background / name check / IBIS check when I got my H-1b. So I hope that I don't have to go through it again.

I'm afraid you will have to go through all those checks again, although it may go quicker. I've lost count of how many times I've had my background check done for various reasons.
