Hi there. basically me and my girlfriend (shes US based0 will be getting married a few years down the line and in reading for research i noticed theres a k-1 and a ir-1/cr-1

now the latter. am i right in thinking means you can get married THEN apply for visa?

im unsure as to which one who should go for anyone able to clarify

* - 18th August 2014 - I-129f Sent

* - 21st August 2015 - Recived at CSC

* - 30th September - NOA 1 Received

* - 3rd November - NOA 2 Received

-- was never sent to NVC, got it re approved --

* - 9th January - NOA 2 approved

* - 13th January - Notice from CSC that it was sent this time to NVC

* - 21st January - Received at NVC

* - 22nd January - Case Number assisgned

* - 31st January - left NVC for London

* - 6th Feb - Arrived at Embassy

* - 10th Feb - Packet 3 Received and DS-160 Filled out.

* - 25th February - Medical :dancing:

* - 26th February - readiness form sent

* - 7th April - Interview - approved

* - 14th April - Visa in hand.

* - 17th April Tickets booked http://itsalmo.st/#timetofly

Yes you can apply for a visa after you get married.

* - 21st August 2015 - Recived at CSC

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

that's not a visa, to stay in us whilst the wait happens.

That's something else.

ive been looking but i can find out certain info. i dont now if im missing it or what.

i read that i could stay in the us while the cr-1 was processed as you get resident permit once you get married

and besides this bit doesnt it mean i can essentially go for a visit and end up married

No. To use a tourist visa and then get married AND STAY is visa fraud.

You have two options:

1. Get a K1 fiance visa, go over to the USA to get married, then adjust status to stay. Good things: slightly shorter than spousal visa, don't have to leave after wedding. Bad: more expensive than CR-1 spousal visa, cannot work or travel for several month after arrival in USA.

2. Get married (either in home country, or during a visit to the USA), then go the CR-1 spousal visa route. Good things: Cheaper, can work and travel immediately once arrive in the USA (handy if money is an issue, or you have elderly relatives back home). Bad: If married in USA, must leave when tourist visa stay is over (but can continue to visit during process), takes longer because you need to get married first, then wait for the marriage cert before you can start the paperwork.
