Am looking for information on this document as I am worried about getting denied. I do make more than the poverty guidelines, but not much. How strict are they with this document? My fiancee has a decent amount of savings. Can I say it is my savings?

Hi,

I believe that as long as you make above the poverty line you should be OK. As far as your fiancee's savings, you can use them as long as it's an account in the US and can be easily accessed (not stocks or bonds).

Just make sure you have all the supporting documents they require such as W2, 1040s, bank statements, etc and get it notarized, and you should have no problems.

November 27, 2006- CRIS email- Green Card Ordered!!!

November 30, 2006- CRIS email-Welcome notice sent

December 1, 2006-AOS touched

The K visas are non-immigrant visas and the first thing that can be considered is the visa applicant's own financial situation. A number of UK K-visa applicants here at VJ have met the public charge requirements with their own financial resources and have not needed sponsorship.

Point of clarification: savings do not have to be in US accounts nor do they have to be in the form of cash. They do have to be "easily accessed", as you say, and overseas bank accounts and stocks and bonds are typically easily accessible.

Hi, i have a couple of questions that i hope someone can answer for me. I am checking into having my Aunt be a co-sponsor for the K1. I make enough money but have not been working for a full year because i was in school to the end of March. Soooo..... I presented the idea to my aunt and she makes enough $, etc. However she has concerns about the requirements of being a co-sponsor and is concerned that her financial situation will be investigated and that she has some unpaid bills that will cause problems.

Does anyone know anything about this? Does anyone know how deep the government digs into the financial situations of the people that are co-sponsors? Does anyone know of anything that could 'come back to bite' her? She's just all nervous about this...

For the I-134, I don't think the government does any kind of digging. The VO/CO at the interview is the only person who takes a look at it. If it meets his or her approval, I doubt anyone else really takes a look at it again, unless and until you have real problems when she arrives in the US and are asking for the government for financial handouts to help support your SO. Then, and only then, will they look at your I-134 again and might trying to collect from your aunt. But it's been repeatedly stated on here that a I-134 is not legally enforceable. So I don't think she has much to worry about. But trying to convince her to believe that is of course another issue.
