RE:PLEASE HELP! My mom is being treated like a dog at work

So the HR guy at my moms job, did nothing. I spoke to him and thought he would help. If anything, I hate fact that people like him feel like housekeepers have no

worth. It's because of them, that they have jobs. They need someone to manage and supervise.

But moving along, yesterday the HR employee for the actual agency, Crothall Healthcare, who's corporate office is located in Denver, contacted me to speak about the issue but she was being so mean and rude too. I just don't understand why no one is doing their job nor care. The whole time she didn't apologize about the issue, didn't tell me why she was calling, nothing. On top of that she made me call her the day after to speak about it and when I did, she told me to email her what happened. I got so upset because she knows what's going on but wants me to email her about it!!!!!!!!!God Why?! I did my research online and found her supervisors name, Raj, he is the HR Vice President, I found his email and CC'd him to the email she requested. Below is the email I sent her. Did I do okay? I don't know you guys but I really want my mom to get the justice she deserves. She is now unemployed because of them and is constantly depressed. I went ahead and made an appointment with the EEOC which is a ten min walk downtown from my job. Was is wrong to also send the email to the Vice President? I changed the names for security reasons

I am sending you this email per our discussion on Thursday, February 7,2013. Although I'm sure Oreo explained in detail what happened to you, I am going to explain it in this email for both our records.

On Friday, January 31,2013, both supervisor Snickers and Kit-Kat interrupted my mother while working to discuss some issues in their office. My mother, Tootsie Roll, entered their office expecting to pick up her check. The check was for her to get paid for the 3 grieving days that an employee must get when a family member dies. Your employees failed to inform my mother of those days and when she went to request payment for, it took them over a month to cut her a check which is completely ridiculous. On Friday, Snicker RETALIATED my mother demanding that my mother gives him a legit reason for her speaking up at the meeting that was held that same week by the HR Department at the hospital due to a significant amount of complaints made by the employees against Snickers hand Kit-kat. Snickers also made comments about her being free to leave work and that no one would beg her to stop from resigning. Starburst, an HR employee was present in the office when the incident occurred as well and did nothing. Along with that, Kit-Kat has also sexually harassed my mother but my mom was too afraid to speak up. Kit-Kat gave her a note saying he "loved her", when she was cleaning his office about 3 months ago. My mom was smart enough to keep the note. After she neglected KIT-KAT, he started making her more uncomfortable at work by constantly calling her during work hours, asking for her keys, the ones used to unlock certain rooms at the hospital. What your employees did are Retaliation and Sexual Harassment, which we both know are illegal and against the EEOC regulations and laws. My mother resigned because she is afraid that she will still be harassed by Kit-Kat and Snickers. I don't understand why nothing has been done or why I haven't received an update on this issue. I ask that you give me an update asap because this a serious matter that needs to be taken care of. Temporary solutions, like an apology, or her job back are not up for discussion. Such case, shows that they both be held accountable for their actions. My contact information is below and I hope to hear from you soon.

Alejandra, you have an EEO issue here.

1. your mom complained about something job related.

2. she was harassed because she made a complaint about something. (This is retaliation.)

3. HR was made aware of the issues, and thus far have not resolved the problems.

4. The supervisors kept harassing her (creating a hostile work environment).

5. The working environment deteriorated, your mom can no longer stand it and quit.

So the above listed items is the basis of your complaint to the EEOC. That's what you have to support as to why you are there. You should present your complaint as clearly and as accurately as possible. And try to follow the chronological order.

The EEOC will follow their standard operating procedures from there. Usually mediation, and perhaps a settlement (if your case is founded).

Not to be an azzhat, but the truth of the matter is that HR is not there to protect the employees, but to protect the company from any litigation arising from the actions you have described above. And yes you did tell the HR representative on the phone all the actions that took place, but they require it in writing so that there isn't a "He said. She said." situation. There are many employees that will gladly tell you all the wrongs committed by their supervisors and co-workers, but will balk at the idea of putting anything in writing.

I really feel for you mother, and you are doing the right thing in bringing this to the attention to anyone and everyone in a postion to make a decision on this matter. Also bringing it up to your state's Department of Labor will also be a option if your mother does not get the resolution that she wants.
