This thread is scary please offer me advice!!! I am a USC and my husband is illegal he came on a visitors visa 6 years ago and overstayed his visa. I see that CAPRI said that if you AOS for your ex spouse or relationships are overlapping that that is a red flag to USCIS. Well I did both. I was married to a man from Nigeria in 2007 I was married there and came home and files for him after 5 years of marriage he got his citizenship and just shortly after that he left me saying he would return one day that he wasnt leaving for good anyways he left in May or June of 2011 and I was devastated I met my current husband in August 2011 and we started dating he is from Cameroon we quickly fell in love I know it sounds crazy but its true and real he moved in in Nov 2011. My ex husband left me in terrible financial debt and wouldnt help me with a divorce I finally divorced in Aug 2012 because I had the money and 11 days after my divorce I got married to my current husband so now I am filling out the paperwork for him to AOS because we finally have the money but this thread is scarey the only evidence we have are pictures and cards and letters and affidavits from family and friends but we have nothing else together because he hasnt had a SS# all this time so he cant share bills or leases or insurance so this thread has really made me afraid please any advice is appreciated!!!

Everyones situation is different. Just because you have a red flag does not mean you wont be approved. A red flag just means a possible indication that something may be amiss. It gives them a starting point to probe at. So you know youre doing nothing wrong, but you also know what it may appear to look like from the outside. So go prepared. USCIS prefers documents as evidence over verbal statements as evidence.

Your story is (and I really dont think its a 'story' but the truth) but your story is- you separated from spouse 1 who obtained benefits from you in June 2011 (bring proof he left you) You were unable to divorce him until Aug 2012 for financial reasons/couldnt locate him/state separation laws- whatever it was (bring proof) At the same time you began a relationship with spouse 2 (bring proof) You married and are now here to adjust his status. You really dont have anything to be concerned about. Just break it down into a logical timeline and have supporting documentation. Make sure you and your spouse are on the same page. You cant say I didnt divorce my first spouse because I didnt know where he was and he says she didnt divorce him because she didnt have the money. They understand life is messy and complicated. But your statements have to be logical, believable documented and they have to match each others.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
