Removal of Conditions and Naturalization

Trying to figure out the best way to approach this. My PR Card will expire in August. So i believe i have to submit a I751 in May for the 90 day window. But in Novemeber is our 3 year anniversary and i plan to submit a n400 for naturalization. I am assuming i have to pay for both back to back but is there an easier way to do this without haveing to pay for both the removal of conditions then turning around and applying for my citizenship. The big rush is that my husband is will be PCSing to S.Korea and i want to be able to go with him. I have read a little bit about aplying for naturalization under 319(b) but i cant find alot of information about that and we could only do that if his orders came in early enough to do it that way. So how would you approach this situation, thanks for your advice.

naturalization isn't based on the length of your marriage but how long you've been legally living in the US as a LPR, the min being 3 years.

I'm going to move your question to the military section of the forums, you might get more help with your expedited citizenship due to military deployment there.

You should also be able to get help on base from the immigration section ( if you guys have one )

So if i understand you correctly, i cant apply for citizenship until three years from the time my PR Card was issued?

Correct...3 years from the date of issuance on your green card.

That is correct, you can apply for citizenship after 3 yrs of living in US not on your marriage anniv.

Most cases ppl will have to apply for ROC at end of 2 years and 1 yr later they would be eligible to apply for citizenship.

Not sure which service center you need to apply to but at the moment Vermont is taking 9 months for ROC which means by the time one would receive their 10 yr card they would be eligible to apply for citizenship.

If my husband recieved orders early enough, would I be able to apply for naturalization under 319b without removing conditions? And if my PR card expired while I was pending naturalization would I be ok? Thanks

Since you already have your PR card when your husband receives orders apply for Expedited Naturalization under 319(b). Go to legal on post and ask them for help if you are unsure on how to go about doing that.

How it work citezeship and conditional resident any help I just join to the navy whit condicional resident my green card expire in September 2014 do I had time please help

We had to apply for I751 removal of conditions. You should be able to mail it within 90 days of your expiration date. I have only been a permanent resident for about 2 1/2 years but i am already a Citizen. I received my took the ceremony and received my naturalization certificate on the 3rd of this month thanks to my husband being in the military and section 319(b) of the INA. . But we did have to file for the I751 and then a few months later file for the N400 since we qualified for 319(b). If you just joined the navy they should assist you in gaining your citizenship. But if you do not meet the minimum requirements you are going to have to apply for your I751 removal of conditions and receive your 10 year PRC until you meet the requirements for citizenship.

Just a quick note in case others search this topic::

As long as you have your PR (green) card AND orders to accompany your spouse overseas assignment, you can apply for Naturalization N400 through the 319b expedite. (We are currently doing this and others here have posted in threads explaining how) but note that

**you DO NOT have to wait 3 years from getting your green card in order to apply for citizenship/naturalization, You are good to go once you have the two things above. Miew only received her Greencard 10 months ago in April. We got my orders in February and sent the package in that week. Hell, we applied for her K1 less than two years ago! K1 and still two months from getting to the states all the way through citizenship in about 2 years, crazy-eh? The longest process we had during this whole thing has been the AOS by far.

**Therefore you don't HAVE to do the I751. We weren't eligible to remove conditions for anther year, so we are basically skipping the whole Removal stage. It must have worked, as we have already received notice of Biometrics at the end of this month, but we successfully did a walk-in, so just waiting on the civics test...

there is the possibility that we do I751 later, but I doubt it, I think it gets skipped in this situation...as it was skipped on others here...
