Hello Visa Journey Members!

My name is V (AOS Spouse) and my husband's name is Boo (US Spouse). We met in March 2010 when we were both studying at University in Switzerland. We started dating shortly after. When we graduated we stayed together as a couple but had to do long distance. I was working in India, my home country and my love worked in Thailand. I got a job in Thailand and moved so we could be together. Well, Boo's Thai work visa expired and so he moved back to the US. Mine expired as well and I decided to move back home and look for jobs in the States. I got a job and really close to Boo! I applied for a J1, that was sponsored by my company, was approved and moved out to the States in Sept of 2012.

After, two weeks of working with the company that brought me into the US they fired me. I wanted to know why and they didn't give me any straight answers. They had me removed by the police and Baker Acted so that I wouldn't cause a 'scene'. I was devastated as was Boo. We decided that we want to be in each others lives and we love each other very much. We got married on the 11th of November 2012 in a lovely civil ceremony. My brother flew all the way from the Pacific North West and my Sister-in-Law drove a long way to get to us too. Our parental units unfortunately couldn't make it to our big day.

We got a lawyer soon after and he has been helping us navigate the labyrinth that is the USCIS as well as helping us with all of our paper work and documentation.

Our papers were registered and being reviewed the USCIS on the 4th of Feb 2013. I know this because I had a rather rude awakening this morning by ICE/DHS. They knocked on my door and asked me about my status and asked to see any paperwork. Luck enough my paperwork is registered in the system. They finger printed me and told me about the laws that is if my paper work is denied, that I will be under their scrutiny and will be deported if I do not leave the country in a timely fashion. And then they left. I have a sneaky suspicion that the company notified ICE/DHS of my whereabouts. I know it's their duty as it's the law. But I can't help feeling so very unsafe at this point in time.

Has this happened to anyone else on this forum?

Sorry for rambling so much, that's my story so far.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

As I mentioned in the topic SteveanTiff links to, I personally believe that there is a tighter wrap around people on student/work visas. You'll have an AOS interview. Just make sure to bring all your proper supporting evidence.

If ICE is out of the picture, I'd start focusing on your only potential red flag(if it is on). You were in the US for 2 weeks, then got fired and married your husband, all within 2 months of your arrival. Nothing illegal about that, at all. However, it might look as if she came with the intentions of using a non-immigrant visa to immigrate with. She doesn't have to prove anything but if asked, it's neat to come prepared and not be thrown off by any sort of questions.

As I mentioned in the topic SteveanTiff links to, I personally believe that there is a tighter wrap around people on student/work visas. You'll have an AOS interview. Just make sure to bring all your proper supporting evidence.

If ICE is out of the picture, I'd start focusing on your only potential red flag(if it is on). You were in the US for 2 weeks, then got fired and married your husband, all within 2 months of your arrival. Nothing illegal about that, at all. However, it might look as if she came with the intentions of using a non-immigrant visa to immigrate with. She doesn't have to prove anything but if asked, it's neat to come prepared and not be thrown off by any sort of questions.

or

2) You were fired 2 weeks later and got married solely for the purpose of not wanting to return to your home country.

So you have to cover yourself and have evidence that none of the above is truth!

was there any coding printed on the J1 visa resembling 'H.R.R.'..... ?

Right on guys. Original Poster's initial intent was to work in the USA. That's easy to prove. But it looks as tho OP got married to not have to return home...

After the OP came to the US her circumstances changed. The job she came for fired her. I don't think the OP wanted to get fired. She got married so she could be with her husband. I think it's all very natural; nothing to be worried about.

Op: You mention the "Baker Act." I looked that up as I don't know what it is... it is involuntary commitment for mental health problems? Your work did that to you?

Just a question, was wondering why the thread was moved? I realize it was kind of part introduction, part sob story.:unsure:

Yes, I originally came into this country looking to be with my love and working here for 18 months on the J1 visa (I don't have the 2 year clause to fulfill). I had initially planned to finish my 18 months and go back to my home country (India ,I am an Indian Passport holder but have never lived for very long in India, my family moved a lot and I have never felt at home there.) After the J1 expired I was then going to apply for a fiancee visa and get married in the US afterwards.

I got fired by the company that brought me in, they were training me still. I hadn't really worked a proper day. The way they fired me was they said I was too 'bubbly' ( I was going for a customer service job, wouldn't you want someone good natured and happy helping you with your cases?) To get me off their property with out causing a 'scene' (trust me I wasn't going to cause one) they called the police and told them I was 'threatening self harm', which I absolutely didn't) The Florida Mental Health Act, more commonly know as The Baker Act, is a Florida statute allowing for involuntary mental examination of an individual. I was held for a 72 hour period for no reason. They take these things very seriously, I had no clue of my rights. And they were clearly violated.

My fiance (now husband) proposed and I accepted. Both are families get along really well. All parents and siblings have met and like each other very much. His parents adore and dote on me. My parents are thrilled to have a son in law. My big brother thinks the world of my husband. I love my sister in law we have so much in common from music to foo to art as well. Even his Gran loves me, and she's one tough bird! In a nutshell we are a big happy family.

I love him, I can't live without him. I need him in my life, we make such a good team. We both encourage each other to reach for goals and dreams, we laugh together, he wipes away my tears (I am the crier, I cry for the tiniest things.) We are each others family. I am glad I married him. If I could go back change my actions, I wouldn't.

I am just nervous, I hope USCIS sees my side to the story and judges me fairly. I don't want to do anything wrong or illegal. I always want to be on the right side of the law.

travelfairy, I got my C permit extended 2 years ago, but I haven't been in Switzerland for the past 1.5 years, I am trying to re-extend the C and if that doesn't work I will get a non-EU B permit but need to look into the restrictions on that before we think of moving. Confusing, I know.

I received my Form-I797C NOA 1 for my Bio-metrics Appointment today! My Appointment date is 03/01/2013! :dance:
