i-864 & i-864a - Completely Confused

I read the guides for CR-1 and the i-864 and everything made sense. Now that i'm filling out the documents, i'm totally confused.

Situation:

I am the primary sponsor, living with parents but i'm not their dependent. My taxes show I make less than the poverty line.

Father is the joint sponsor but has filed taxes jointly with spouse and have no dependents. He makes 90% of the money.

I thought I would file a i-864, my father would file an i-864 as joint sponsor (since I only need to use his income and not his spouse's) and he would file the i-864a since we both live in the same house.

Questions

1.) Does his spouse also need to file i-864 since they are filed jointly?

2.) Does she also need to file an i-864a?

3.) Will he need to also send in his W-2 to show that he does in-fact make 90% of the amount listed on the Tax Transcript?

4.) Is my assumption on the forms even correct? Me: i-864 , Father: i-864, Father: i-864a

Any help in the right direction would be appreciated since this is totally confusing.

1. Only if she's going to contribute her income. If she's not, then she doesn't need to file a form.

2. Dependent on if she's going to contribute. If she does, then yes it would be an I-864A.

3. If he's going to send tax transcripts as tax information, then yes, he'll also need to include his W2s to show his portion of the income on the transcript.

4. No, that's wrong. Each person only fills out ONE form. You would fill out your own I-864 and your father would fill out his own I-864. The only I-864A that would be included is if your father's spouse files as well.

Nope. He can submit an I-864. An I-864A is typically done by the spouse of a joint sponsor, who's also contributing their income. For the I-864, it doesn't matter if you're in the same household or not.

Not true. You were told wrong. Saylin gave you exactly the information you needed.

I-864a is for combining income.

You say your tax return says your income is below the poverty line but tax returns are the past. How is your "current income"?

Not true. You were told wrong. Saylin gave you exactly the information you needed.

I-864a is for combining income.

You say your tax return says your income is below the poverty line but tax returns are the past. How is your "current income"?

Current income is about poverty line but i'm self-employed so I didn't want to chance things by writing up a letter from myself to myself saying I make enough money. If I had 1099's to send in, I would have done that.

For the self employed, your 2012 tax return, line 22 IS your current income.

Hey,

I was having the exact same confusion. So just to clarify my hubby (UCS) will file the I-864 and his mom is going to be our joint sponsor therefore she will also file an I-864? Even though they live in the same house they don't need to bother with the I-864a correct? And finally, if we don't need to file the i-864a does that mean both hubby and his mom leave line 21g blank on their i-864 forms?

Sheesht - There should be a degree in visa journeys at the end of all this. More terminology here than in my actual degree haha!

Excellent, thank you! One other quick question about the I-864.... Part 5, 21a (persons you are sponsoring in this affidavit) my hubby would enter 1 (for me), then 1 for himself on 21b. However 21h says 'add together the lines and enter the number here. Household size' - Would this be 1 or 2? Adding the lines together we get 2 but I don't live with hubby so surely I shouldn't be included in 'household size'?

P.s. Hubby is just starting a new job as a teacher. This salary will bring him above the poverty line, however the job he was doing before didn't earn enough which will show on his tax documents for last 3 months. Is it okay to still use his mom as a joint sponsor even though his new job earns enough?

The answer is two. The intending immigrant counts in the sponsor's household size. He should NOT count you twice so, 21c is blank.
