We had our AOS interview in the middle of October. At the interview the officer informed us that they were still waiting for the FBI to complete the name clearance.

That was over four months ago. WE contacted our Senator and we received a letter that they can do nothing and that we will just have to wait and they have no idea how long that wait may be. I call the Senators office and spoke to the Immigration aid, she told me basically the same thing, but did add that she has seen cases where the people are waiting over 5 years for the clearance. That depressed the hell out of me.

Our fingerprint card will expire in 6 weeks too. So I am wondering if that means we go back to the first step all over again because of that.

Has anyone dealt effectively with the FBI name clearance issue. Meaning get them to move it along.

Any ideas advise sympathy :hehe: will be greatly appreciated

There was another poster here last week or so for whom it took a full year for the FBI clearance. So! It is not the first time. Hopefully, yours will get resolved shortly. Good Luck

HI im really sorry bout your case just when you thought it's going to be over huh! I hope your gonna hear something frm them soon.

April 25,06 started working.

Aug. 18,06 passed the colorado driving test

Sept. 28,06 got my own car

Carina is still waiting for the FBI clearance too...since late October. I have tried everything, contacted congressman/senator, e-mailed the FBI, sent a letter to the local USCIS office where the interview was....all with very little success. No reply from FBI, senator, and USCIS, though the congressman's office did reply eventually and said it is "still pending", and to check back in 90 days. Haven't called the FBI yet but I guess that is an option too...just don't know how much good it will do.

Funny thing is that Carina's mother was approved no problem at the interview and there is only 1 letter difference in their names, and they had the biometrics done at the same time. Carina's prints will hit the 15 month mark end of March so we'll see if we get any notification for new biometrics.

I have heard the horror stories too of long waits for the clearance but I am choosing to be more optimistic and hopefully this will be cleared up sooner or later and Carina will have her card.

Hi,

I am waiting for FBI name check to be compeleted since May 05.no news yet.it seems it is endless.I am very unhappy coz I have to reapply for work permit again.this would be the third one :crying:and after that I have to :whistle: go to DMV to renew my Driving license again. :crying:

it seems they have forgotte :(:unsure: n me. :blink:

Maria's name check took almost a year. We started contacting the local Senators office and they talked with the INS and told us that there is nothing they can do as its in the hands of the FBI. We then went to renew Maria's EAD and during her fingerprinting an INS officer sat down with us and told us when the FBI does the name background check the name is sent to 26 different countries and they have to wait for a reply from each country before they can continue. So its up to the countries whom your name was sent to to respond quickly. Who the countries are and how they pick them I have no idea but they told us each case and name is unique and thats why people have different approval times. We were really getting tired of waiting until we got an official letter from our Senators office stating the FBI had contacted them and told them that Maria's background check had cleared. It was about 10-14 days later we got the email stating her case had been approved. It does help to contact your Congressman. Hang in there and yours will come soon. Now we are waiting on her son's approval as he is a K2. He didn't have any background check as he is 10 and they told us that his case would be approved with Marias as he is her child. We still wait.......

Can you tell me how your Congressman was able to help? I'm wondering if I should just be a pain in the a$$ to the immigration aids that work for my Congressman and Senator. Ya know just keep asking more questions. Anyone think that may be a good or bad idea? I like it though since they all seem to pretend that they are doing something for their constituents when if fact they do nothing.

I never heard about having to send names to 26 countries to get a name clearance. Although it shouldn't surprise since most of what USCIS does makes little sense to me.

I just got back from my interview, and guess what...

SAME PROBLEM, still waiting for the FBI Clearance!!!!the officer who interviewed us told us that the fingerprints were cleared but the name not yet!!! :crying:

He said it might be because I had an H1B1 Visa before, he doesn't really know...

I mean it's frustrating, everything in the interview went well, except for this, and from what I'm hearing, this might take a lonnng time :( the officer said that our case is "APPROVABLE" but he can't do anything till they get the Clearance....

Instead of trying to call the misinformation line all the time and getting no where contact your Congressman and let them know your situation. They can be in direct contact with the FBI and give you heads up on when your background check clears. There is little you can do or the INS can do or even the FBI in a name background check. The INS officer told us that they have to wait for responses from all 26 countries. It used to be only 24 countries in the background check but that was changed just recently. Don't get obtuse with your Congressmen or women just let them know your situation and let them be your liason instead of trying to call the INS customer hotline and getting no where. You must be patient cause your background check will come thru.
