Three approvals one RFE for stepdaughter!!!

My husband petitioned for his mother, his daughter, myself and my daughter (his stepdaughter) who is 4 years old. All petitions have been approved, but there is a RFE for my daughter. What could they be needing? My husband just got the email notifications so he has not yet received the letters to know for sure. Nevertheless i am extremely anxious because i do not want my process to shoot ahead of my daughter's. Anyone with any ideas of what they may be asking for...i am almost certain her a copy of her birth certificate was included in the package.

The available evidence indicates that when an RFE is issued, the file is parked on someone's desk waiting for your evidence, and a decision follows shortly after they receive it. I don't expect that her case has much time left to go. Wait a few days to get the letter saying what they need. It could be simply that the cases were split between two workers and one asked for something that the other one didn't ask for. My guess is that they need something about your daughter's birth father, but I have no way of knowing, and it could equally well be something stupid that you already sent.

I'm a dual US/Hungarian citizen (both by birth; Hungarian citizenship verification TBA), and my husband is a dual British/Irish citizen (by treaty) from Northern Ireland. We are atheists.

Did her biological father sign that it was ok for her to leave.

Did you include your marriage certificate with her application? This has to show you got married before the child was 18 (I know she's 4)

Were you or your ex previously married? If you were previously married (either or both of you) did you provide copies of your divorce decrees?

If you forgot her birth certificate then they will need that.

I don't think you'd shoot ahead of her. Ours (me and 2 sons) were combined right away. So even at NVC when we had a hold-up for one of my kids, they just waited for his to catch up to the other two before moving along.

Thanks for all your comments, advice and insight everyone. IT feels awesome being a citizen of this digital community. Everyone just wanna help! It tears me up!

I think we might have foolishly thought that since they were all packaged together there was no need to send more than one copy of the marriage certificate, thinking the one copy of the evidence could be referenced on both files. The certificate was attached my set of documents, so none would be on my daughters documents.

Thanks to visa journey, now i know they seem to adjudicate petitions separately even if they go in together. I am so anxious to see the rfe letter, to be able to feel 100% excited for our approvals put this behind us.

I feel like I wanna start a discussion that says APPROOOOOVED!!!!!!!!!!!!!!! but need to have them all in that category to

get my happy feelings soaring!

If you didn't include the items for each package individually then I can't see the RFE being about anything other than that. Remember that each I-130 is its own petition and needs its own supporting documents. When you get to the next stage keep that in mind as well. Even though the files are related to each other, they are NOT sharing evidence even if it is the exact same. It is better to send too much than ever to assume that they will go looking for what they need in another file.

If the daughter's petition is lagged at USCIS, it can get caught up again at NVC with the rest of the casefiles by having the USCitizen Petitioner LAG on stuff...

Update: My husband finally got in hand today the rfe for my daughter..It is a generic letter that states that he should submit item checked. However, no item on the list was checked. A line called other was added that said "Please submit initial evidence of proof of relationship with [my daughter's name](marriage certificate and all divorce decrees, which would suggest that those are what they want as we had assume. Problem we are having however, is that they state in the letter they want him to hand deliver it on March 26, at 9:00 (New York - Manhattan field office).

My question is do we have to wait that long just to give them a document, or is there anyway we can still wake into the office and hand deliver them. We are worried that our other cases would long be at NVS before my daughter's case get reviewed again at the USCIS stage.

I heard of vjers using info passes, is that option something we can take advantage of at this time and how does it work and how do we get it?

Should we call USCIS for more information?

So the good news is that it is what you expected in terms of the necessary documentation. The bad news is that they want it hand-delivered on that date. Is it ON that date or BY that date? I'm sure you must be able to get an earlier appointment. Have you asked them directly?

So my husband finally got an infopass appointment to hand deliver and see an office on the 26 of February. However, his conversation with personnel (teir 2 i assume) is that they want him to take in the AOS documentation, pay stubs, job letter, passport-size photo, current tax return, as well as the marriage certificate.

1. Why would the need all these before her petition is approved at USCIS?

2. Isn't that what they ask for at the NVC stage, and not at a field office?

3. Is it something new for them to want these documents this stage? My husband is frustrated and I am confused!

4. Don't they just put a check mark besides the items they want you to submit in rfe? None was checked except for the other that ask for the marriage certificate and the divorce decree.

5. Is it possible that he was misinformed by the representative he spoke to?

Since my landing in visajourney, I have been gathering a wealth of information, so I am able to pick up on unusual happenings, that my husband might not be so aware of, so he he tends to just listen to everything they say and less of what i have to say from my research on this site, so you can imagine the struggle.

Any help or clarity on this matter would be greatly appreciated.
