hello there. my first post is a litttle difficult and am desperate for some advice if any of you can.

my husband and i got married a few months ago but for personal reasons that i do not wish to say on here, i came back to the uk at the beginning of the summer before we were able to afford the pnext stage.

now we are doing the cR1/ir1.

here is our problem. we were married by a family friend. we had a license to get married in one city, but due to timing and poor weather, changed the venue and he agreed to marry us at home. so on our certificate it says we were married in xxxxx by mrs xxxxx (who is able to perform ceremoneis) and in reality we were married in the same county but not the same town.

so we are about to fill in our 325 and it says city of marriage, my husband i very wary of not telling the truth here (although only 4 family members no). as if we are found out of lying we could go to prison? perjury?

i want us to be together, and if we both put the same town everything would be fine and also our friend would not get into trouble. but my husband is an honest man sometimes too honest. i respect what he is saying and dont want to force him into doing something he is worried about.

our lisense was for the town that we didnt actually marry in, but on our certificate it says we married in the 'correct' town. if we do tell the truth, that we married in a different town, is our marriage then void? what wuld we do? im gessing then we are not legally married, so would we be able to go through the fiance visa again.

im sorry. i cant go into anything more personal like the whys and werefores, as this is a very sensitive issue so i would like some genuine constructive advice please. ive been reading this forum for a few months now and it can tend to get a litttle hairy! thank you for reading this.

im heartbroken by all of this. we may be told to see a layer but both of us are quite poor and we struggle to make ends meet at the best of times.

Were you married in the US? Vital statistics recording is typically done at the county level of government.

YMMV

lost,

Have your husband speak with a family lawyer in his area. For a very few dollars he should quickly get answers to all your questions about the validity of your marriage, and if there are any problems he'll learn what needs to be done to correct them.

I agree with fwaguy that it is typically done by the county and not the city. You should contact the county the marriage took place in for the answer. This really doesn't seem like a big deal, hope you get it sorted out.

thank you.you guys are so kind and helpful. do you know what kind of department we'd be looking for at the county, would it be a town hall or something?

City Hall is the place where you would of got your marriage license from, did you>??..............did you get your license & then after your wedding did you get your marriage certificate??

EDITED to give e.g..................

I also got married in the US........we went to Detroit city hall to get the license, after the wedding we went back to city hall with the signed license & they converted it into a marriage certificate!!........BUT not all states are the same here its all on the same paper license & certificate.....other states may issue seperate bits of paper

thanks very much yodrak. its a bit confusing, but if i am reading it right then if we *chose* to be 100% truthful, then we just have to forward the certificate to actual town clerk of where we got married in?

that said, our family friend could be in trouble because it says we were married in the town our lisense was issued in on the cert.

i think my husband and i. have some talking to do over the weekend...

i aksed on another site and was advised to talk to the county clerk too, and a family attorny. if our marriage is null, or nullable, could we get re-married? would we be allowed to do the k1 again?

thank you all very much for your time and patience

It sounds to me as if your "marriage certificate" has the correct place of marriage on it.

I don't think itt matters what the license says. USCIC wants the marriage certificate.

Does the marriage certificate say you were married in "Fairfield".?

If it does, it sounds correct to me.

For example, I picked up my marriage license in Billerica Massachusetts, and then was married in Sudbury Massachusetts. The person who married us sent the lincense back to the Billerica town hall and we picked up the Certificate there - certificate states we were married in Sudbury, which is correct.

I think in many states (if not all), you don't need a license from the specific town you are marrying in. I could have been married anywhere in the Commonwealth of Mass, however it is recorded at the town hall where I obtained the license.

Here's the Fairfield town hall inf,

I'd maybe call the clerk there and explain the situation, they may be able to advise you better,

as they've probably dealt with this before.

Marriage License Town Clerk, Old Town Hall 256-3090

Getting Married in Connecticut

The Marriage License

The marriage license may be obtained in one of the couple's towns of residence or in the town where the marriage will take place.

It could possibly be amended, however your friend may have to answer as to why she sent in

the incorrect information. The may view it as a simple mistake (which it very well may have been).

I've looked it up. A marriage certificated in Connecticut can be corrected or amended to change incorrect information. So call the town hall and get it straightened out.

thanks for that, so much, its such an emotional time. i cant believe how helpfull all you kind people have been.something i will never forget. i do think though that it has to be town specific for the marriage but maybe not.

i just found this for the state of ct. rom the link you sent jane. im not too good with the wording but it seems like out marriage is not valid

I'm not a lawyer or anything close to it, but, I read the summary to say that it validates a marriage that would have been invalid because it was in the wrong town. That is, your marriage would have been invalid if it weren't for this bill. That's how I read it anyway.
