I would assume you have been married 2 or more years?

You need to show evidence of an ongoing relationship before and after marriage is what they like.

What is your "evidence of living together"? Letters are useless so what PROOF do you have? Bills? Tax returns? ID's at the same address?

i don't think letters are useless. when i filed my i-130 for proof i submitted pictures of me and my husband, affidavits (with the info the instructions request) from friends and family as well as an affidavit from my landlord saying we had been renting from her. most places here don;t have leases and we were never able to have a joint bank account being from different countries. i never got any RFEs.

If you are newly married, it is understandable that you don't have much stuff together yet as a couple.

But for ROC (after 2 years of marriage), one should have some sorts of co-mingle finances to prove on-going relationship.

E.g. Jointly-Filed Taxes, joint credit cards, bills, both listed on insurances ..etc

Letters/Affidavits could be fabricated and at best only secondary evidences.

I think if there's little evidence of co-mingling of finances that could be a problem. From what I've read here it's a very big thing they look at. I'm not sure if you have stated it and I missed it but it doesn't seem like you do. To me at least this could pose a problem.

Do you have papers showing each others as beneficiaries? Benefits together? Taxes filed together? Something that shows that level of 'trust' in a relationship? To go 2 years in a marriage and not have any kind of indication of co-mingling the rest could just look 'staged' and easy to do. It shows there is no 'risk' to the marriage should something go wrong, which in some cases can flag fraudulent questions.

Your evidence of living together is alright but you will need some evidence of inter-mixing of finances. Try to get your foreign spouse added to your 401K, Medical, Insurance, Vehicle Ownership, Checking Account, Credit Card Account at least now. Think about anything else that is specific to you that can be added as additional evidence. You probably will need letters from your neighbours and get those notarized.
