Hello VJ,

I hope someone can help me with the questions that I have for the paperwork I have to fill out on the I-130 PartC. #17 Does my husband list his children even if they dont live here in the US and we are not filing for them?

On PartD. #2 Have I ever filed a petition for this or any other alien?

My answer would be yes I did file for my ex husband and when he got his citizenship he left me something I really don't want to tal about but it is what it is will this be a problem for us it asks name, place and date of filing and result is this just for the I-130??

On the paperwork for the I-485?

ON Part 2 which do I check I dont know which one applies to him since he has been in this country 6 years without papers and came on a visiting visa.

Still list his children even though they are abroad and we are not filing for her?

And if he answers yes to the question of being in jail or being arrested do we just explain on a separate sheet of paper as he is not really in the system technically with a record because he has no alien number or ss#

Thanks so much for your help!!!!

Yes, you definitely need to list it. They might ask you about it to determine whether there was fraud in that last petition. They might put more scrutiny on your current marriage because you petitioned your last husband and it didn't work out.

ON Part 2 which do I check

Check "a"
