My cousin filled for his brother to come to united states as his brother 13 months ago . Now the brother got accepted as an employee here in united states, can he now apply for his work visa and you think he will be approved or they will reject him based on he has a file in progress?

I doubt the sibling petition will influence it much, as he'll need to wait 10+ years for that to be current.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Yes the employer will petition for him. The brother here got a notification that your petition has been approved and forwarded to NVC . Yes they know it will take 10 years before a sibling get approved for immigrant visa. They are worried about a question on forms where it says have you ever been applied for a US visa or has someone ever applied on your behalf, then why this question is on visa application forms? what should they answer.. My cousin is worried if they answer no, The immigration might find out since they have a file under his brother's name or if they answer yes, what will happen ? since you say I doubt sibling petition will not influence? I heard you can not apply for visitor visa if you have a pending petition, Is that just for visitor visa or ALL type of visas? what is Law says in here? I mean If this person has a job opportunity why can't he apply now? that family visa matter is a decade+ away?

Where did you hear this?

Has he discussed lying on the application with the Lawyer handling the work visa?

If your cousin answers no to the question about applying for visa or being petitioned, it will be dumbest thing he could do. He will be denied for material misrepresentation (lying) and will get no visa at all.

A family member of mine was waiting for her K3 visa, denied visitor visa since she declared that she has her husband already filed K3. We are thinking if my cousin's brother apply for his work visa and tell them yes I have my brother in US and he petitioned family visa they might refuse it. If the law is not prohibiting it then it should be good, correct ?

They are not trying to lie and have not applied yet. Its just an opinion that they are asking form you, which option is the best. Its a great opportunity for him to be approved for a job now the employer is trying to apply for his visa and asking him to fill some forms.

Hopefully it is the Lawyer who is asking for information.

The visitor visa was not refused due to a K3 being in process.
