Hello VJ,

I am not sure if I am posting in the right forum please correct me if I am not. I am getting ready to file my husband's paperwork and trying to get everything together. I asked before and printed off everything for the K3 and AOS since he has been in the US for 6 years illegal he overstayed his visiting visa. We have been married since August. I need your help so much I feel so overwhelmed as I am using this site to try to fill out the paperwork myself.

Will they accept his passport even though its expired the Cameroon Embassy will not issue him a new passport here in the US without valid ID like a SS card or Green Card and its like he doesnt exist here. So can I copy what he has and still submit it and his birth certificate. Also do I need to submit the physical I forgot what it was called with the AOS and do I mail both petitions for the K3 and AOS off at the same time. I have many more questions but I will just ask as I go a long bit by bit.

K-3 is not an option. You should be looking at CR-1 papers. Hes trying to adjust status from a visitor visa not a family based visa. So I will move this to the correct place for you now. The medical is required yes.

I haven't talked to the embassy but I will try but I heard that they will not give him a new passport without a valid id like a EAD card, Green Card, or SS card all of these he does not have they will tell him to return home to get it which there is no way he can do.

You should talk to the embassy...I don't think they should require US identification to issue a foreign passport. Does he have his birth certificate and any photo ID from Cameroon?

Use the guide Darnell posted. He is in the US, a visa is used to enter the US, so he doesn't go that route. With AOS, and his long overstay, he shouldn't leave the US until he receives his green card, or you are looking at a ban that will have to be overcome.

You don't need a valid passport to AOS. Expired passport is okay. (some countries won't let you renew abroad if you cannot show legal presence in the foreign country, in the case, here). You do need to get a medical done beforehand and mail in the results with your package. Look up "Civil Surgeon Locator" on uscis.gov.

Oh dear, no. You file a I-130 and I-485 together and all related forms (which is a lot). Did you look at the guide Darnell linked?

Oh dear, no. You file a I-130 and I-485 together and all related forms (which is a lot). Did you look at the guide Darnell linked?

Thank you I did look at the guide so I mail all those forms together in the same package even the EAD is included in the payment do I need two separate money orders one for the I-130 and then another one for the 485 or do I add the fees together for one money order.

The only evidence we have are cards and pictures we can get family and friends to write affidavits do they have to be notarized? Any suggestions on evidence we have nothing together because he does not have a valid id or SS #

Personal check is better than money order because you can track it in the bank, but one check or two makes no difference. Follow the instructions on the forms (each form has a separate instruction package you can download).
