We are still waiting for my AOS and I dont't have any income for 2012. Can we file a joint tax return on my husband ITR and deduct standard deduction for married filing jointly $11,900 and exemption of $7,600 ( 3,800 x 2)?

AOS

July 30, 2012 - Sent AOS Package

Aug 03, 2012 - Received NOA ( AOS, EAD, AP)

Aug 08, 2012 - Received Biometrics Letter Appointment

Aug 17, 2012 - Received RFE Letter

Aug 24, 2012 - Biometrics at USCIS Charlotte

Sep 05, 2012 - USCIS received response to RFE

Oct 06, 2012 - EAD Card Production

Oct 15, 2012 - EAD/AP combo card on hand

May 07, 2013 - AOS approved

May 16, 2013 - Permanent Resident Card received

As long as one of you have income and you are legally married by the end of 2012, you can file married filing jointly and get the exemption and deduction.

Yes you can file married filing jointly but you have to attatch a statement stating that you wish to be treated as an immigrant since you were not yet a Greencard holder last year..

Unfortunately you cannot file electronically as you have to attach that statement sign by you and your spouse.. What we did with ours was we filed through TurboTax, printed it, signed, attached the statement and mailed it to the address that TurboTax gave us..
