AOS Denied. What next?

But wondering if we don't have any people here who went thru process of appealing BIA?

AOS (from H1-B) Timeline:

Day1 -- 09/23/2012 - 130, 485, 765 AOS package delivered to Chicago Lockbox

Day4 -- 09/26/2012 - Emails/texts acceptance confirmation in evening :-)

Day5 -- 09/27/2012 - Checks Cached

Day12-- 10/01/2012 - Received hard copies of NOAs for I-130, I-485 and I-765

Day16-- 10/12/2012 - Received Biometrics Appointment(appointment for 10/24/2012)

Day16 - 10/12/2012 - Biometrics Walk In - Refused

Day20 - 10/16/2012 - Biometrics Walk In - Successful :)

Day33 - 10/29/2012 - EAD card Production Ordered-Pleasant surprise :)

Day37 - 11/02/2012 - EAD Card received - WoW !

Day40 - 11/05/2012 - Interview letter for Dec 4 date - The BIG Day !

Day70 - 12/04/2012 - Interview done. Pray to GOD!

Day95 - 12/28/2012 - Letter for 2nd Interview in Feb

8/17/10: INTERVIEW DAY (day 123) APPROVED!!

ROC:
5/23/12: Sent out package
2/06/13: APPROVED!

My husband has been married before to a GC holder and was divorced 3 years when we met for the first time. He did help her get her US citizenship but I think it was more because she was a US Army officer and less because she was married to him that she was qualified to get her USC. They were married for 4 years and their marriage did look pretty genuine to me. will that effect my marriage too? She really screwed him over though and I know I am paying the price in terms trust because of it from him. I don't need the USCIS people punishing me for it too.

If you guys have strong evidences of a bona fide marriage, then not. If it's poor one, then yes. The fact that any of you were married before does make USCIS to take things a bit more cautiously but if they see that you guys are "real" then you'll be fin. It is also a big bonus that he was divorced for 3 years before he met you, so it's not like he was all depressed and desperate to get someone as a wife real fast and hence you took advantage of this and jumped into the relationship so that you could get a green card. So, again, I think you guys will be fine, just have good strong evidences, keep the divorce decree and if you have anything to show that you guys met 3 years after his divorce than it's awesome!
