AOS Denied. What next?

Thanks but that lady was a ###### with separation or no separation plus my husband and I were prepared for a 4hr interview about our lives together rather than what happened to me 12+ years ago especially since she didn't like when I answered "I don't remember". Anyhoo we are past that now and just waiting for our approval :)

Oh wow .. now I started to worry a lot!

My local office is also Oakland park, and for my husband this is 3-rd marriage. He is USC now, but he got his GC thru AOS from the 2nd marriage. And his first marriage was when he's been young and stupid and lasted just few months.

On the other hand I'm adjusting from F1 status, never been married, but we dated only an year before marriage ... I just saw so many red flags, that I never thought about :unsure::blink:

I hope you'll get approved fast! :thumbs:

I am glad officers like that woman thoroughly check for scamming immigrants and kick out frauds. Good for her.

You know if that officer were half as good as you think she is, she would've bothered to look at all the proof I already had with my previous marriages and she wouldn't have had to treat me like i was scamming the system, so no, no good for her, rather shame on her for not doing her f'ing job! After all, they've have 9 months between the 1st and 2nd interview to go through my previous files with a fine toothed comb, but what can you expect it's a government employee

First of all, a big big congratulations, and if you don't mind, a big e-hug for you! :) Wow! Seemed like your interview wasn't one that was so pleasant and gave you a warm feeling, but hey, put it behind, it's all over now and you came out as being approved, so that is good. I hope you'll get the actual notification over mail soon as that one is the one that gives you security that this is all true, and really done. :) And then of course when your green card will be sitting in your mail warming the mail box. ;) Yay! Congratulations again, and I'm happy to hear from you! I hope GreenTrain is doing all right, I've been thinking of him a lot lately, wondering where is he, did he move already, or what...I worry about him...:(

thanks so much! yes that officer puts the other ones to shame, but i made it, and she doesn't have one leg to stand on to say that i got married for a GC. She may feel that way but she's not hired to adjudicate on her feelings but on the hard cold facts which are in front of her and there are way too many facts that prove her wrong. God some people on this site need their heads checked, i swear.

I think GreenTrain is very close to doing his appeal; i really hope he's working with a lawyer because it's a complicated process. Anyway ill keep you guys posted, positive thinking from now on! :)

thanks! it all depends on the officer and it's a lottery. The fact that the person adjusting (you) hasn't been previously married is a plus. Because it seems like all the want to do is prove that at some point you married for papers so that even if your current marriage is real, you wont be able to adjust.

Do these people forget that divorce rates in the US are at 53%, the odds are against us! My first husband, born and raised in the US, has been married 3 times and now his 3rd wife just left him (he got married almost back to back too) but of course in my case, I must be a scammer because i am not from here and in need of a GC; that kind of thinking is extremely closed minded and the worst thing is that immigrants like us that already have their GC, think that officers like the one i had was just doing a fantastic job and she wasn't at all!! it's very very sad.

USCIS seems to deny a lot of adjustments of status from F1. You come to the US when you are young (18/19), pay sky high international student college tuition, go through a myriad of unforeseen and unforeseeable problems, but more than likely still manage to complete college. But USCIS will never forgive you for a mistake like falling out of status at 19. Very sad and brutal.

Also, if this goes to BIA court,

Please give me an high level idea like what steps happen, when and how?

GURUs, Please help me with following questions:

1. How long it takes to get decision on appeal?

Are you in status during that?

2. Do we need to attend the hearings or its just attorney,

3. If appeal is pending, do we get another interview for AOS(if we re-file)?

4. If appeal is pending, EAD is valid or not(issued from last I-485 filing)?
