I am a green card holder, I want to ask a family petition for my mother. She had a hemorrhage in the brain little less than two years ago I am a green card holder for about the same time. I know as a green card holder will take very long time to be granted a petition but for these circumstances can I get my case expedited since I am her only daughter and the closets relative. Can I get any suggestions as how to get her into the USA faster.

Thank you for any help.

None, You must wait until you are a US citizen, or you can go back home to be with your mother. You can file for a re-entry permit which will allow you to be out of he country for up to 2 years without losing your LPR staus.

^ If your GC was approved through VAWA you shouldnt need to wait 5yrs, you should be eligible in 3.

(this is a rather old memo though- you can repost your question in the VAWA thread and ask Sandranj to confirm if its still accurate)

Three years because you were approved through VAWA.

Visiting the US for medical treatment is a valid reason to get a B-1/B-2 visitor visa (though it is certainly not guaranteed, and she may have to show that she or you will be able to pay for her treatment). Her valid nonimmigrant status could then be extended every 6 months in 6-month increments. When you are a USC you can then petition for an immigrant visa for her (or possibly for her to adjust status).

If you want her here for medical treatment, she can get a tourist visa for that- you'd need to show you, or she, can pay for the treatment. Similarly, when the time comes for you to petition her for a immigrant visa/ greencard, if she still has heath issues and medical treatment due to the hemmorage, you will be required to show you can afford the health insurance for her over and above the normal 125% poverty line.

There is nothing stopping you from visiting her.

Your mom could get a tourist visa and stay with you for 6 months. My dad is from Peru too but he lives in Honduras, I am the only daughter he has, and my mother passed away in 2000. He got the tourist visa and has been here already twice, and one of the reasons I would like to have him more with me is because his health conditions worsen in Honduras. However, until I get my US citizenship, which will be this year, then I can request his residence. If I could go, I wouldn't hesitate, but my husband is also suffering really bad from Chronh's. Will be praying for you and your mom, hoping that pretty soon you both will be together.

I think sometimes they will say they need medical proofs that the medical condition cannot be remedied in her country or treated, also you will need insurance for her, or a Dr who would commit to treating her and the hospital payments ensured prior to applying for the visitors visa based on seeking medical treatments....best wishes

You will not get Insurance for a pre existing condition.
