Timeline

Hi everyone,

I was looking for help as to what my next steps would be so I can be prepared when the time comes.

I came to the US on a K-1, married within a month and a few days, did my AOS which was approved 2012-06-08.

What I am needed to know is do I file for I-751, Petition to Remove the Conditions of Residence or N-400, Application for Naturalization, confused about the difference. Also when do I apply for this?

I am completely confused and need any help offered would be appreciated.

Sorry in advance if I forgot to put pertinent information here that may be needed to answer my question. I will gladly answer any question if more info is needed for a response.

When you filed the AOS, you received a conditional GC which expires within 2 years of your LPR status date. So you must file ROC or the I-751 during the 90-days before your conditional GC expires. You need to include joint financial information, joint tax returns, and other evidence that the marriage is legit and not for for the purpose of avoiding US immigration laws. After you have been married to your USC spouse for at least 3 years (minus the 90 days again) you can apply for citizenship using the N-400 form. If you get divorced you will have to wait for the 5 years as a LPR to get citizenship. Please have a look at these under teh GUIDES section of this website.
