Yes that has changed. In 2010 I693 was required.

Maybe the Op's wife is missing some shots and hence the RFE for I693.

He should check the USCIS web site for required shots with what was done\given during the medical for K1 to see what shots she is missing.

I adjusted status for my wife and 2 sons in 2009 and it was not required, JUST the DS 3025

the rfe says form i-693 was not received I looked and the form is very different from the med exam sveta had in kiev and yes we sent copy of report from kiev so how should we deal with this? resend the report from kiev with letter stating this is what was given?

We didn't receive a RFE but our case sound similar as we had a interview instead and at the interview the officer gave us a form to go get the vaccination recorded completed by a civil surgeon in the USA, she also had to take 2 vaccinations that were not completed before. Once we finished them we returned the sealed envelope to USICS officer and then they approved her green card.

Once we finished them we returned the sealed envelope to USICS officer and then they approved her green card.

Actually, you DID receive an RFE. You received it at the interview.

RFEs can be delivered at any point in the process. It is also possible to receive an RFE AND have an interview. AND receive a request for more information at the interview. That's the best part of this process...anything is possible.

Oh, and I forgot...if anyone makes a mistake, it is YOUR problem. :blush:

how would I fill all this from what I see none this appies to us more like deferred action read the dates

8/17/10: INTERVIEW DAY (day 123) APPROVED!!

ROC:
5/23/12: Sent out package
2/06/13: APPROVED!

sveta told me again last night the exam in kiev told her she had everything and was complete for her age that applies

It does not matter what they told her. If your response to the RFE is "They told Sveta she had everything" your AOS will be denied. Period.

You ONLY need to do what the RFE says. Copy the RFE and post it.

Nothing else anyone says or said matters, Ron, you need to do what the RFE says.

Ron, please, if you want us to help you (and we CAN) then post the RFE letter in entirety. You are confusing me with the "he said, she said" none of that matters...even if USCIS is WRONG, you STILL Have to do what the RFE says. We try to avoid RFEs but when you get one you have no choice but to comply. Well, I guess you have achoice, bout you have no choice that will be easier, faster or cheaper, let's just say that.

talk to tier 2 officer at uscis their first words was why was I sent request for a i-485a as this does not apply to us . and also said since was not given the i-94 at poe and had get new the med exam does not cross to new i-94 track number . lastly I was told to write a letter stating none this applies due to 1. the medical is under year old 2. aos was filed before the k-1 visa expires so the i-485a does not apply 3. to let uscis know a new i-94 was given and to give the infomation of the cbp officer that gave new i-94 and copy of boarding pass as proof due to never received at poe and uscis can track the docs from there.........I have no problems doing what is asked as long as it applies the i-485a is for someone not legal or is out of status ( over stayed )

IF your I-485 application was submitted within one year of your fiancés medical, then he/she does NOT need another medical.

However, as part of the medical they would have given him/her a vaccination record. It would list all of the vaccines that they received or had proven they had had, at the time of the medical. At the bottom of that form are three options. I can't remember the exact wording, but the first says that all vaccines are complete. IF that is the case, sending in just that form should be enough, and you shouldn't be asked to submit form I-693

The second box they could have checked says something all age appropriate vaccines given and applicant may be eligible for blanket waver. If they checked that, there are differing opinions on if you should do the I-693. Some say they didn't send it and got away with it. Others have been requested to submit the I-693. We went ahead and had a civil surgeon transcribe our DS form to the I-693 to be safe. For example, my wife received a varicella vaccine at her interview, but that vaccine requires a second dose two months later, which we had done. When we met the civil surgeon, he said she required a second TDAP shot since her medical, so we did that too. He then transcribed all of that to the vaccine section of the I-693. But since her medical was less than a year old, she had no need to do a full another medical. And she had had a flu shot at our local medical center, and she had that transcribed to the I-693 as well.

The cost from the civil surgeon was $50 to fill out and seal the form I-693, and another $40 for the TDAP shot.

The third box they could check is the 'Incomplete' box, in which case you MUST go see a civil surgeon and finish getting all the shots that they say you need.

So pretty much, unless your DS form says 'Complete' you should probably get a civil surgeon to fill out the vaccine part of I-683

But be careful. Of all the civil surgeons I contacted, all but ONE tried to tell me that we needed another full medical, something I KNOW 100% to be false, and they wanted to charge us like $300+. Finally I found the one who knew and was willing to just do the vaccine part.

Be advised, nothing the tier 2 officer says imposes any requirements on the adjudicator handling your case. Let me explain, in the case I worked with...

1. Applicant got a letter, RFE stating she needed some vaccines (which vaccines she needed was not indicated)

2. They called a tier two officer and went through the list of the vaccines she had off the DS 3025.

3. The tier 2 officer told them they "were fine, just send a letter explaining that and another copy of the DS3025" YAY!!!!!!!!!! Dumb@ss adjudicator made a mistake!

4. They did what the tier two officer said

5. Her AOS was DENIED and she was ordered to leave the country! Reason? She did not get the I-693 as instructed!

6. Within 30 days he filed a motion to reopen (I-290)

7. Upon review it was found that the adjudicator was wrong and her green card was approved. YAY!!!!!!

8. Ultimately the adjudicator explained that it was because NONE of the boxes were checked and the adjudicator did not actually read the form to see that she did have all the vaccines.

1 YEAR later and $585 extra for the motion to re-open. As opposed to perhaps $200 for the Civil surgeon.

And it does not matter whether you NEED it, they can make you have one and pay for one just to get their signature.

We worked with Senator Leahy to draft legislation to allow ANY US doctor to sign off on these. You could go to your family physician. So far it has not been passed but is part of the current immigration bill (which I do not approve of except for that part) :blush:

At any rate, there is an attempt being made to end this parasitic Civil Surgeon business.
