Hello,

Active Duty Military here in Germany....My wife and I married in Thailand June of 2012 and I filed my I-130 petition for her the following month and it was approved 59 days later in September. She has been here in Germany with me since Mid-october on her SOFA visa ( i understand it is not a real visa).

My question is that we are not leaving Germany until at least 2015 and I have no clue what is the next step in the process. I would like to get her a green card now so she can visit the states whenever we want or in case I get a last minute work trip to the U.S. The end goal is to get her U.S. Citizenship.

So what is next? I-485??? I'm kind of lost as most of the documentation is for people who intend to immigrate right away.

Thanks!

-C

The validity of the I-130 you filed in June of 2012 will expire before 2015. I know that you can delay the NVC steps for awhile, but I doubt you can delay them until 2015. This should probably be posted in the IR-1/CR-1 forum, but I'll have a moderator make that decision.

I-485? heck no.

Consular Processing for the Visa !

there's intake to be done at NVC.

So, find LingChe in the wiki, and go forth, rock n rolla !

once she has the green card in hand, if she's on yer PCS orders, her time spent with you overseas DOES COUNT for citizenship stuff.

Thanks! We are going thru the command sponsorship thrash right now. They don't do new orders unless you get married before the actual move. However, I'm sure there is some record stating she is command sponsored, if not my CC can do a memo. I'll check out the wiki as I'm not sure what forms/process/steps I need to do.

She has to have a command sponsorship letter. No new orders will be given. Though you should check wifh MPS if there were additional years or months added to your tour in Germany in exchange for her command sponsorship

Yes I will be here an extra year because of the CS.

I just found the letter the embassy sent me when the I-130 was approved. Basically I just need to send in the 230 part 1 and 2 and work directly with the consulate here in Frankfurt. Thanks VJ :)

Sorry, I missed one big thing - you filed the I-130 to the USCIS office in Frankfurt, no where in the USA.

So, forget any NVC steps. My bad.

The rest of the processing will be the Visa Processing with Frankfurt - follow their instructions.

I'd think going thru consular filing will be the faster route. We actually explored that option but was denied as my husband was stationed in the US. I've seen ppl getting their approval in three months! We filed our I130 in August, still waiting until now, thanks to the illegals causing a backlog in the system :(
