INTERVIEW - NEED ADVICE!!!

Hello Everybody!

I am going to have my interview soon. It's a family-based application. I received a Notice of Action with information about the interview and checklist of documents to bring to the interview. I guess it's a regular Notice with stipulated set of information requested, am I wrong or the NOA can be customized for every case? I have the questions, mostly about the sponsorship part.

Questions:

1. what kind of questions should I expect, will there be any traps, catches? this is NYC office of USCIS

2. in the Notice of Action with info about the interview they request (UNLESS ALREADY SUBMITTED) the following documents:

a. "Federal Income Tax Returns and W-2's, or certified IRS printouts for the most recent tax year" - I have two sponsors: my wife and a joint sponsor. I already submitted all the tax return documents for 2011, 2010 and 2009, as well as IRS generated tax return transcripts. Do we need to file 2012 right now to provide them with 2012 tax return? We planned to file 2012 taxes in April.

b. "Letters from each current employer, verifying current rate of pay and average weekly hours, and pay stubs for the past 2 months" -

My wife/primary sponsor: she's a babysitter, which qualifies her as a self-employed independent contractor. We already sent USCIS a letter from her client; she is paid in cash, with no paystubs. Will it still be a problem? I-864 instructions says about the self-employed sponsors that they have to send Form 1040 and corresponding schedules. Paystubs are not obligatory.

Our joint sponsor: when I submitted evidence requested in RFE (I did it in October 2012), I sent his pay stubs for 9 months (January 2012 - September 2012), W-2s and all other docs. I didn't send the letter from the employer, since USCIS didn't require it in RFE. Shall I bring his pay stubs for January-February 2013 (past two months) to the interview, as well as the letter from the employer?

3. Supporting evidence of our relationship, "Bona Fide" - I am going to bring our lease agreement, joint bank account statement and photos, showing timeline of our relationship. Shall I take anything else, have I missed anything?

Thank you.

My timeline:

6/11 - My F-1 student visa expired

7/11 - My OPT (optional practice training for F-1 students) started

7/12 - My OPT ended

8/12 - Applied for AOS (family-based)

9/12 - received a RFE (required joint sponsor)

10/12 - I submitted the RFE

1/13 - I received NOA about the interview

The interview notice is the same for everyone.

1. No tricks.

2. a. 2012 is not due yet. You already submitted originals in your packet? Then no need to bring more.

b. Bring an update employment letter or updated paystubs.

3. Bring what you have.

AOS for my husband
8/17/10: INTERVIEW DAY (day 123) APPROVED!!

ROC:
5/23/12: Sent out package
2/06/13: APPROVED!

30-40 is definitely enough. More important than quantity, make sure you have photos representing different periods in your relationship. For example, maybe a trip you two took together.

My officer didn't even want to see pictures, so I wouldn't worry too much about them.

Sethless,

Thank you! Shall I dress formally or usual way?
