Ya know how they say 6 months of waiting on uscis? I bet they mean 6 months of "working days"! Jerks!

Well, I started in this thread. I'm just continuing to hang out in the thread from inertia and to complain about how little pattern there is in the process and to gripe about how little the powers-that-be care about giving us a little transparency, at least, if they can't bring themselves to make the process a bit quicker.

I'm a dual US/Hungarian citizen (both by birth; Hungarian citizenship verification TBA), and my husband is a dual British/Irish citizen (by treaty) from Northern Ireland. We are atheists.

All advice is given pursuant to the Disclaimer that you may read at the bottom of each forum page.

LATEST STEPS:

28 Jun 2013: POE Houston

08 Jul 2013: SSN received (at SSA office)

07 Aug 2013: Green Card received

27 Feb 2014: Whoa, life happened. Planning move "back home" together to Republic of Ireland by end of April.

29 Apr 2014: POE Dublin through Heathrow

I just got back from my InfoPass appointment. I wish I would have never went.

The IO there told me that I-130 petitions are not being processed at Pitt which is UNTRUE as I have seen members on VJ get transferred there. You can also see the case volumes on the USCIS website which show a spike in I-130 volumes at the Pitt office starting in Aug. 2012 that have remained steady throughout the rest of 2012. I almost feel like USCIS is trying to intentionally conceal or hide this information from us. I just don't understand.

They also told me that my petition will be rejected without our Indian marriage registration. I just kept telling him the situation, that we cannot obtain this document, that the marriage registrar is not issuing the registration because of personal bias and is not following the appropriate laws. He told me over and over again its not possible without the registration. He gave me useless suggestions like registering our marriage in another district in India (not possible and illegal) or marry in another country. I told him we have evidence showing our attempts, court order, and other documentation and he said this will not be enough crying.gifcrying.gifcrying.gif

I'm sick to my stomach and I don't know what to do. I guess my only option is to go to India to live for some time and get on my hands and knees begging this marriage registrar guy to register our marriage. I don't know how its possible for me to get over there right now without a job and little money coming from my unemployment checks.

Should I withdraw my petition, knowing it will be rejected? I can't believe its come down to this. I really thought we had a chance. I don't understand how every other India member on VJ managed to get the registration except for us.

Can someone who has moved abroad with their spouse give me some suggestions on what steps to take? What did you do with your bills? I probably won't be able to get a good paying job over there, certainly not enough to pay for my bills. I have a car payment (sell my car?), an apartment lease until August, student loan debt, etc.....

Shaking right now with disbelief. I don't understand how we could be so unlucky.....

I'm so sorry Aksinghsingh. I have some experience up and moving to a foreign country, but because I'm still in university, my student loans are deferred. Perhaps you can go to graduate school in India? I don't know how far along your education is now, but it is an option.

Is there any way that the registrar can be persuaded? Is he maybe waiting for you to grease his palms? Sorry to put it so bluntly, but desperate times...

Maybe you could get him a Schengen visa and get married again in Europe? Being married to an American and having an I-130 in process might be enough to convince them it won't be a problem...

AK don't start making plans before something happens. You don't even know if you're petition will be sent to the Pitt office. They specifically said that they are not processing i130s, which you know for a fact is wrong, how do you know that their information regarding your rejection is right? Just be patient. Once you're sure that you're petition has been transferred, you can try to contact the people who told you to submit your application w/out the marriage certificate and to have them intercede with the Pitt office on your behalf.

My point is, all is not lost, this is doable, your situation is just going to require a lot more work that's all. Don't start making plans to pick and leave yet!

I probably don't qualify for this thread since I already have my NOA2, but after waiting 190+ days for my approval and seeing others struggling just as much as I did during the never-ending wait, it really twerks my nerves to see people celebrating "finally" getting their NOA2s after a mere month or two. It's not that I'm not happy for them, because being far away from a loved one is terribly hard, but I find it a bit disrespectful to make topics with the lone purpose of celebrating while others are almost at the year mark in the waiting line, or have difficult, stressful situations to deal with. Really, unless they have a legit question or problem to deal with, I don't see the point in making a topic with a "woo, got my NOA2!" subject line. It's really agitating. <_< Really needed to get that complaint off my chest.

Trials produce patience. This has been trying for my wife and I. Therefore, this wait is or will produce patience in us. Though I may not notice it right now, and though I'm tired and irritated, I'm hoping that after this, not much else will make me antsy. Or at least less things will make me antsy! :)

I intend to make a thread when I finally get my NOA2! I just don't like it when people put "finally" in their thread after only a couple months of waiting, because it makes it seem like they've been waiting a long time. Though, a long time to some might not be a long time to others. But I try to be supportive (and sarcastic) when I say, "Finally! It's about time!" in their thread and my timeline shows I've been waiting for about 8 months and five days.

Is that bad? It might be a coping mechanism!

You're much more positive than me. That's the best attitude to have, though. Props to you for being optimistic.

And no, I don't think that's a bad way to respond! Whatever works for you. I just personally find it obnoxious when people shove short timelines in the faces of others who haven't heard anything in MONTHS or are having a lot of problems during the process. You're just nicer than me.

Well, who came blame them for being happy, right?

I think for me, every time I saw one of those my mood just sunk to the floor, which obviously wasn't their fault and me just not coping well with this waiting. I've made it my mission to not open any approval threads and pretend I don't see ones that have the number of days in the title.

I've been working on convincing myself that because we were transferred to a field office at the end of January (which they didn't probably even receive until 3 months after we filed) that we are due in for a wait for an I-130 approval in April at the earliest. It seems many others are waiting 2 months+ after their transfer for I-130 approval.

When you get your NOA2, I will be saying “Finally!" right along with you!

I really feel for you guys.

It does make me wonder at times if part of the delays is to try and weed out the fake relationships. Instead it puts strain on the real ones.
