please help my husband won greencard in 2007 and iwas included since we got married in 2006 and had a son together inthe same year. so after the medical we were both shocked to find out that i was HIV positive but bboth my huby and son were negative so i was supposed to apply for waiver but didnt, after the 2010 lift of HIV from the list of diseases we decided to do the petition again. and we started the process in 2012 after my husbang had got a more stable job my petition went through and am waiting for my interview which is coming soon.my husband is a US citizen now. questions

1. do they still test for HIV.

2. will they give me a visa despite my status.

3. if am asked about the reason I didnt go with my family should i state the reason.since afriend of mine told me they delete records after every 5 years.

4. will this delay my visa

am really worried have been longing for my family fo so long dont want to be away again.

They will not test you for HIV. If your application is otherwise approvable, and you are in good health otherwise, HIV status will not prevent you from getting your visa. You should ALWAYS tell the truth to an immigration official because even if they have deleted your record (which is not necessarily the case) they have ways of finding things out through other sorts of investigations or even by something you said accidentally.

What impact this will have on your interview I don't know, but perhaps that website will have more information for you.

The law now states that positive result of HIV alone cannot bar you from seeking a US visa/residency. Also, your friend is wrong. I know people who work in the State Department and they never delete records - they just may store them electronically after a while. If they ask you about your status or about your previous application you must tell them the truth. Lying leads to misrepresentation bans which are most often permanent.

If the sole reason for your denial in the past was because of your HIV status then you shouldn't have too much trouble now that the ban is lifted. Remember that your health isn't the sole determinant of eligibility for the green card. You need to be otherwise healthy though and free of other communicable diseases (like TB) which the Medical Exam doctor will test you for. Take care of yourself and wishing you all the best.

They will know of your past HIV results. You will be asked if you ever applied for or were denied a visa in the past and you will report the prior DV based denial. Your husband might be asked to prove that he can pay for any medical costs associated with your HIV if you are having issues. Otherwise you should be fine. In all dealings be 100% honest.

This will not be over quickly. You will not enjoy this.

USCIS stage ( 66 days)
10/12/2012: NOA 1
12/17/2012: NOA 2 (case was transferred to NYC office 11/27/12)
NVC stage ( 20 days)
01/08/2013: Case # and IIN assigned ( file arrived NVC mail room 12/20/12)
01/09/2013: AOS invoiced and paid, DS-3032 emailed and mailed.
01/16/2013: IV invoiced &paid. AOS & IV mailed in one package(arrived 01/18).

01/28/2013: Case complete!!!
04/19/2013: Interview; APPROVED!!!!!
05/13/2013: POE; JFK

New Interview date: 2012-02-29 : VISA APPROVED
