Hi everyone, I am filing my tax return and my spouse needs to have SS number or ITIN, since we have out AOS interview on feb 26, how long in it after that to get green card and go get social security number? I just like to know is it better for her to get ITIN on wait to get SS before the filing deadline. Thanks

She could have gotten her SSN after she arrived using her I-94. You can get the SSN as long as there is at least 2 weeks before it expires. She could have also applied for the EAD and AP when filing for AOS. The EAD/AP is usually received 2-3 months after filing and can also be used to get an SSN. Since your interview is this month, just wait for the green card to get the SSN. Taxes are not due till the middle of April. She should have it by then. If not, file for an extension.

please tell us why she not chase after a SSN within the 90 day period on the I-94?

She should have applied for her SSN the day after she arrived. K-1s are eligible for an SSN from day 1 until day 76 of their I-94 authorization. She didn't, so...

Go to the SS office with her visa and I-94. They will give you a letter which says she is not eligible for an SSN at this time. File your tax return. Where it asks for her SSN, write "Pending" and attach a copy of the letter. MAIL your return, you cannot file electronically without an SSN

That is all you need to do. We did this for our two LPR sons (K-2s) who are NOT eligible for an SSN until they have an EAD or green card.

If you also applied for an EAD, you can get her SSN as soon as that arrives or as soon as you have her green card

Irrelevent at this point. My wife had her SSN 36 hours after she arrived, she applied for the number 16 hours after her arrival.

After applying, you can go back to the SS office and get the NUMBER the next morning, her card came in 6 days. She opened her very own Credit Union account 37 hours after arriving and had her very own Credit Card with a $500 limit. Witin 40 hours of arrival she had a 50% private grant for her MA in teaching English and began classes on day 5.

Waiting around is nonsense. Didn't we already wait enough????

if your sopouse is in the u.s get a tax extension for 6 months file. when your spouse gets the social security card.ma ybe two or three months if that.

Not necessary to delay anything. He will just have to file the old fashioned way...he can still use direct deposit.

This is the part of the journey where you learn that there is LIFE after the K-1 visa.

When u say file old fashioned way, you mean file as single?

NO. I mean to fill it out, print it, sign it and MAIL it. A paper return. You can still use direct depsoit to get your refund (if any) sooner
