father's consent for K2

My fiancée has an 8 year old child. We plan for my fiancée and her child to travel together to the USA upon receipt of a K1 Visa for my fiancée, and a K2 Visa for her child.

I understand that the child will not need a passport (birth certificate instead), and I also know that her child will need the medical test and immunizations. But I am now learning that the paternal father's consent will also be proven to receive this K2 Visa.

She was not married to this man and he has regularly shown is desire to keep her down. He doesn't want her to be happy.

Does anyone here know what kind of evidence is needed to release this child into the mother's sole custody for the sake of this K2 Visa?

Thanks.

But I am now learning that the paternal father's consent will also be proven to receive this K2 Visa. I DON'T THINK SO I HAVE READ HERE THAT CONSUL WILL NOT ASK ABOUT THE FATHER'S CHILD, MAYBE SOME

I HOPE ANYONE WILL CLEAR THIS.

Have a careful look on the Consul website, if they have one. In my country I had to have a signed affidavit from the father stating that he knew his child was immigrating to America and he gave his permission for her departure. Ask for expert help if you need, to clarify this so you can get it right for your situation.

Your fiancee doesn't need the consent of the bio father to let the child immigrate.

In the Philippines, illegitimate children are under the full custody of their mothers.

You listed the child on the petition for the K2, but the child will need a passport for the visa process at the embassy.

Mother has sole custody of the child in the Philippines. Nothing is needed from the father.

lufthgiled, Thanks. We will get to work on his passport IMMEDIATELY. I am relieved about your comments about not needing the father's consent.

You are most welcome. You can fill out the form online for passport appointment in dfa website or use an agency.

If your fiancee get the passport own her own it will cost 950 pesos

If you'll use an agency it will cost 2,000 (that's what my agency asked me)

anyway I am just giving you an idea.

Mother has the full custody of a child so I guess you have nothing to worry.

:)

The child will definetely NEED a passport to travel and of course the medical exams which is included in the fees.

I had 2 kids from a previous relationship and with me not being married to my ex gave me the sole costudy of my 2 kids.

Your fiancee will need a CENOMAR or certificate of NO marriage to prove she was not married before.

As long as ur fiancee was not married to her ex legally then there is no problem.

My kids came here through IR2 though but i came here on a k1 visa.

Trying to get Fiancee's daughters passport for K-1/2. They'll bring Cenomar to DFA.

To confirm, even if daughter (illegitimate) has fathers surname on Birth Certificate nothing is needed from father?

Thanks!!!

Still not an issue, mother has sole custody of the child.

exerpt:

CAN A TRAVEL CLEARANCE BE ISSUED TO ILLEGITIMATE CHILDREN WHO ARE STILL APPLYING FOR THEIR VISA IN THE EMBASSY? Illegitimate children are under the custody of the mother. If they will be traveling with the mother, they are not required to secure a travel clearance from the DSWD. If they are traveling with person other than the mother, they must secure a travel clearance. - See more at: http://www.dswd.gov.ph/faqs/travel-clearance-for-minors

....the mother has the absolute parental authority over her illegitimate children - See more at: http://www.dswd.gov.ph/faqs/travel-clearance-for-minors...

Just arrived in Alabama Thursday Sept 26. Fiancee is from philippines with 6 year old. She was annulled from her ex. We were never asked at interview for parental consent and at airport was never asked for anything. They only looked at passport, visa, and visa packet.
