K-2 VISA holder wants to return home

Hi,

I didn't know if anyone else had ever had this situation, but a week and a half ago my fiancee arrived in the U.S. with her K-1 Visa and her son, who had a K-2 Visa.

We live in Champaign, IL and we registered him for classes in the 8th grade yesterday. During our registration process, we saw students disrespecting office personnel, the Policeman assigned to the school walking in and out trying to solve a bussing situation, office personnel using walkie-talkies to try and keep track of kids causing problems, and then when we left, a fight had broken out amongst some students and a Police car was there.

I couldn't believe it. And my fiancee said she was worried about her son(who doesn't speak English). After a long discussion we decided he's not going back to the school, and in fact, we've agreed that he should finish his high school career in Lima, Peru (his hometown).

So I was wondering if anyone knew: Can the boy receive a change of status(and become a naturalized citizen) and return to Lima now or does he have to stay in the United States until he receives his change of status?.....a process that I believe takes 7 to 9 months after we're married. We believe it's the later, but wanted to check.

It's not "change of status" that you want for the boy, and adjustment of status does not confer citizenship.

Didn't realize that things were so bad in Champaigne IL - is private school an option?

Unfortunately a Private school is not an option, because of the costs of the private schools here and the fact that the private schools aren't prepared for students that don't speak English.

Maybe not a private school, but is there any other school in the city you can register him in?

That sounds like a pretty bad school. Are there any others that don't have the need for such a large police presence that you might get him transferred into? How much longer does he have to complete his schooling? Have you considered trying a home school program? I would suggest you contact the school district first and see what is available. The problems of bringing him back to America after school aren't insurmountable as long as he is under 21, but they magnify greatly after that age.

I think you should all consider the difficulties involved before you make a decision. I am now in the process of applying for permanent status for my wife's son and he just graduated from college in June. Luckily he was under 21 and was able to apply for a K-2 visa under his mother's visa approval. That was because her visa was approved less than one year ago.

Also, you might write to the U.S. embassy in Peru directly. Provide them with as detailed a description as you can regarding the situation include the embassy case number. Give them a chance to explain your opportunities for him to return after school has been completed.

To answer your questions, all the Jr. High Schools here have Police in them. He has 5 more years of school to finish. We hadn't considered a home school program, I couldn't do it.

I will be contacting the school district tomorrow though, to let them know we will not be attending the school here.

Yeah at the end of the day, it's exactly that, "a very difficult situation". But, thank you for your input.

Have you considered Home School for him ?

See if you can find a retired school teacher in your community.

We have one here that will home school for us....the retired teacher is excited about having a foreign kid for a student.

Your town..I was stationed at Chanute AFB for awhile in the late 60's on a school assignement.

I remember it was not a big town but a very friendly town.

I'm an 8th grade teacher of pseudo self-contained students - self-contained because I have the discipline problems AND that sounds like the school I work at.

It's tough and honestly I wouldn't want my child to study where I teach.

I've also been to Lima and I know that schools are not like that - at least in my experience.

Could you look into charter or magnet schools? They're public - you should just need to apply.

Yeah, in general Champaign is a friendly town, as is Rantoul(Chanute AFB), but in the last 10 years the public schools have lost enrollment, and the 3 private schools here have increased enrollment. And thus you have this situation where the kids that remain in the public schools aren't always the best kids.....there's no nice way to say it. craig

Each situation is different, It all depends on how you raise your Kid, there will be very strong influences, peer pressure, but the love and caring that he gets from home will be the solid foundation of his childhood. I grew up in the project and so as many of my friends, Yeap not all of us made it, some got hooked onto the fast money, the fast life and end up losing their youth and future being locked up in Jailed, but the others went up to become Doctors, Lawyer, and even One NBA player, Stephon Marbury yeap he's from NY from the hood but he's an all star now, and there are so many more examples. Have faith in God and teach the right values to our kids.
