h1b visa vs Employment-Based immigration

hi all

my cousin is a CPA ... whats his chances to find a sponsor for h1b visa or employment based immigration , he is already in a tourist visa ?????

and if he find a company whats the most frequently process h1b or employment based immigration ?????????? he need to fill a adjust of status or he most travel to his country to receive the visa ??????????

how you switch between h1b and employment based immigration

under which categories the CPA CLASSIFIED IN EMPLOYMENT-BASED PREFERENCES ????? Priority Workers, Skilled Workers, Certain Special Immigrants

Any insight will be appreciated

No one can tell you wha his chances are because no one knows his qualifications.

As a CPA in his country, does he know US accounting and tax laws?

An H1-b is an employment based visa. So your statement of switching from an H1-b (an employment based visa) to an employment based visa does not make sense.

There is zero chances that your cousin can switch from a tourist visa to a work visa. It simply does not work that way.

Finding a US employer is only the first step. It can take more than a yer for a willing US employer to bring someone to the US on an employment based visa.

Don't expect to get an employment based visa during the time allotted or a b1/b2 visa holder is in the US. Even with a 6 months I-94, there is not enough time for n ploy meant based visa.

First, he needs to stay in status to be eligible for H-1B or employment based green card. If he is on tourist visa and does not leave when his I-94 expires, then he is out of options for getting H-1B or a green card in US anymore.

Second - both H-1B visa or EB green card require employers that will incur all the associated costs and sponsor him.

His likely will be 3rd preference unless he has appropriate degree - then maybe 2nd.

Companies typically don't deal with people overstaying their visitor visas. The file for EB based green card way less than for H-1B and in case of non-current categories (for some countries EB categories are not current) overstayed results in the same issue as with H-1B.

What I think companies do is choose another person from thousand out there... Violating immmigration law is a great recommendation for an accountant.

Most likely it would be EB3.

Usually and Employer would use a L or H as an interim work visa.

I hope you don't mind me asking, but why did he go to all the effort of qualifying to work in the US if he has no right of abode in the US?

cpa is the highest qualification in accounnting in USA and all over the world he make the cap & cma because its a good qualification everywhere, he is already working in his country but he is willing to work in USA

and by the way he didnt brooke any immigration law he is just coming to usa as tourist and will travel...... am just wondering if the H1B visa unavailabel whats the compannies do in these circumistances ????????????

If H1B is unavailable, they recruit from the USA instead, if they can. And I'm afraid that may be what they would do even if H1B is available.
