My wife who is a U.S citizen filed I-130 for her mom. After approval of I-130 we are trying to file I-864 for her mom. My wife began a job in NY in June 1st 2012 earning about $29,200 while I worked in MA from January to October 2012 in MA earning about $17,600. I just moved to NY to be with my family after leaving my job. We have one child and I am trying to get the earned income credit So my questions are:

1. How many people does the NVC consider my household size to be?

2. How should I file our taxes to get the earned income credit? Married filing jointly? Married filing separately?

As always thanks for all of your help. I wish everyone here sucess in their journeys.
