My question is about the I-134 tax return requirement. My fiancee's K-1 interview is March 1st in New Delhi. Am I to provide the tax return for 2012 even though it is not due until April 15th? Or is 2011 tax return sufficient for interview that is before the April 15th tax due date?

Thanks :)

Yes the 2011 return is the one to be used since the deadline for 2012 hasn't been reached. However if you did file your 2012 return and have it available then you can use it if it shows more income :star:

Sent I-129 Application to VSC 2/1/12
NOA1 2/8/12
RFE 8/2/12
RFE reply 8/3/12

NVC received 8/27/12
NVC left 8/29/12
Manila Embassy received 9/5/12
Visa appointment & approval 9/7/12
Arrived in US 10/5/2012

Thanks a lot! It will be a big hassle to get the 2012 return filed before the interview date, so I'm pretty relieved that I can just use 2011.

Do I need more years prior to 2011? I've seen some people saying to provide last 3 years if it is not the tax return for the current year... but 2011 is considered the current year until April 15th to my understanding... so I don't need previous ones as well?

Previous 3 years of tax returns are a requirement of the I-864. I'm not sure about the I-134, what do the instructions say? Tax return transcripts can be easily ordered from the IRS website http://www.irs.gov/Individuals/Order-a-Transcript

It is common for the Indian consulates to request 3 years of tax return information for the K-1.

I am the petitioner.
