Poverty guidelines not needed for k1 visa???

I respectfully disagree with Gary and Alla.

It doesn't make sense to approve a K-1 where the sole sponsor does not meet the poverty line because the poverty line comes into play during AOS with the I-864. Why let a K-1 in when the I-864 requirement is not clearly met?

Isn't it a bad policy to let a person move to the US, get marry, and then not be able to adjust because the sponsor does meet the poverty line?

Please come back and tell us if the k-1 is approved when you are the sole sponsor does not meet the poverty line.

It has happened. A case comes to my mind from about 1 or 2 years ago. Not Egypt, but someone going through Juarez did not meet the poverty guidelines and gave them their I-134. They brought an I-134 and financial documents of a co-sponsor because they knew they did not earn enough. They were never asked for more financial proof or the co-sponsor's papers. They were approved.

This is something rare though. I would never recommend someone go to the interview unprepared. If you know you do not meet the requirement, then get a co-sponsor for backup no matter what someone on the phone told you.

Some Consulates allow you to self sponsor.

At least one does.

Some allow co sponsors, others do not.

The bit that makes no sense is requiring a sponsor but not caring how much they make. $1 or $1m. Makes a difference.

Thanks guys!! I was shocked at the info as well since it was the first time I hear it.

I spoke to two different people. I mean why would they give out wrong info? And like I said, one of them as a supervisor.

They said that since K1 visa doesn't need a I864 then poverty guidelines don't have to be met.

I submitted a whole bunch of evidence of proof of money that my fiance will take with him as well as a bank statement from his dad saying that he will support him even after he travels.

I also submitted papers from my father saying that he will support us.

I am soooooo sure he won't become a public charge. I just hope they will realize it as well.

The embassy gave you the correct info after all, you were referring to the I-864. With the K1 it requires the I-134 to be filled out by the petiitioner and the co sponsor to be included in package 3 or presented at the interview.

The I-864 is needed when filing for Adjustment of status when you're in America. For the I-864 if you're under the poverty guideline you will also need a co sponsor. Good Luck :)

This is more informative than generalities.

The input of people that have used the consulate you will is more valuable than anything else. I suggest you check this out in the MENA forum with other members that have used the consulate.

Exactly. You need Embassy specific info. You can ask people in the sub forum of Egypt and trust people that went through the Egypt embassy.

Some embassies will require that you make the 125%, that you bring papers that are not supposed to be requested for I-134, that you have a co-sponsor... some other won't take co-sponsors...

Please, ask that question again on the Egypt sub-forum to have answers of poeple who have experience and can tell you exactly how it goes.
