Timeline

Hello, I am a new user on here....We are using a lawyer to go through this process but I still like to check up on the wait times and process for my own eyes.

We submitted our I-129 on January 9th, 2012 and we have not yet received our 1st notice of receipt....Is this normal? Our I-130 receipt came so fast, (6 days) and gave us so much hope :(

Can someone please advise of how long it usually takes to get the 1st notice, and then 2nd one???

Why are you doing a K3? If your lawyer put you up to it I would seriously re think my choice of lawyer.

I'm confused...are you married or engaged? You say I-130 which would imply marriage but then you say I-129 which is for a Fiance Visa.

You may want to read the guidelines for yourself.

Umm, you are aware that the I-129F is used for the now obsolete K3 visa for spouses?

Thank you for the feedback everyone.

I was denied entry back into the US in late November, 2012, so the only way and fastest way we were told to get me across the border was a spouse visa. Yes we are married, we got married December 2012 a month after I was denied entry.

Maybe this information will help to clarify things.

I understand that you are married but your laweyer should know that the K3 is an obsolete visa. CR1 is what you want to go with

I went through the exact same thing as you did, denied at the border, obtained counsel and we did both forms. The way it works i that if the 130 is completed first, the 129 becomes obsolete. The 130 is want takes you to the IR/CR1 which is what you want, which is what I got. Every one gets their first NOA quickly, it is just to tell you that they have received it and that you now can hurry up and wait...It could be anywhere from 3-5 months for them to get to your 130 form. It will then be transferred to your local USCIS office where the petitioner will get called in for a very easy interview. When my wife did hers, the lady already believed we were married and just asked a few questions.

After that they send it to the NVC where it begins being processed. Once you have filled out the online form and paid the fee it takes less than 20 days to be processed and sent to Montreal which is when the applicant's interview date, that will come about 6 weeks later depending on how busy they are.

It is a lengthy process and hopefully you don't run into any snags as I did, all of which can be seen on my profile About Me section.

You can check other profiles to see Similar Timelines to give you and idea of how fast the 130s are being processed. I believe mine took longer because when it was finally transferred to the local office, it was just before Christmas (19th) so I believe I lost time there for about 2 weeks...

You just have to be patient and wait your turn, if you have a good lawyer, then they will stay on top of things.

Umm, you are aware that the I-129F is used for the now obsolete K3 visa for spouses?

why do you call K3 visa...an obsolete visa? this is what i think: the i-129f application will most of the times get approved faster than the i130....and that's what you pursue to bring or to get close to your fiance or spouse as soon as possible, dont it?

Because USCIS generally pulls the I-130 out of line and puts it with the I-129f. Then they're normally done together and sent to the NVC together where the NVC closes the I-129f. Recently an I-129f made it to the NVC before the approved I-130 and it was closed at the consulate because the NVC had an approved I-130 by that time. Also I-129fs are processed at about the same speed as I-130s right now, some I-130s are processed faster.

It's obsolete because it takes as much time and in the long run costs more and is less effective because it's a non-immigrant visa.
