so let me get this clear ..

I already filed the I130 which was like ~500$

now if i file for I129 that is free

but

after I129, if i go the AOS route, that will be additional ~1000 or i could wait for my CR-1 which wwould be less im persuming ... does that sound about correct, so technically there is no harm in filing for I129 since other people are being told to apply for it

Yes.

Although I-129f might take just as long as I-130. K-3 processing is very inconsistent... (surprise, surprise)

Hello VJ friends from February...I just wanted to share my experience for the past month. I also am in the same boat...at the beginning of the month I decided to call USCIS and check on my status..(I have not been able to view case status online EVER). I was told that my case was transferred to my local office and that was it. The person working for the Congressman was always a day late, and also confirmed the same thing a day later. I decided to go talk to someone at this local office with an infopass appt which was scheduled for Oct 17th. There I got some disheartening news/ok news. I was told that 400 cases were transferred there along with ours, and they are taking over the processing now. Also, that it could be another 2-3 months. I knew to ask the woman whether they are just taking random files from a pile, or if its going in order..which she told me that they go in order. I then asked her where they were at...month wise...and she stated that she picked on up the other day from late Feb/early March...she told me mine was in a pile ready to be worked, but that it could take 2-3 more months as there were only 3 people working there. She told me to send more info...after discussing with her what I actually initially sent...she told me i'd probably get a RFE..and to go home and send more info. I went home Thursday and sent more info which included pictures, passport stamps, Western Union receipts of money I'd sent, boarding passes, phone bills..and anything else I could find. I got confirmation that it was received Monday. Yesterday at work I decided to go to the USCIS website and try a shot at my receipt number...which I'd memorized how many times it's been put in...and finally something showed up and it was the news I wanted....that they APPROVED our I-130 on Monday the 21st..and that I'll be receiving something in the mail. I didn't know whether I mistakenly typed in the wrong receipt number or not..so I made sure it was...did it again..and same message showed up. Mind you...I have not received a thing in the mail since my initial NOA1 and also no case status online. We were approved 1 day short of 8 full months. My suggestion to those still waiting...schedule an infopass appt at your local office or wherever it's located and go ask...ask them what they are doing. Hope to have more of you guys with approvals. I wanted to share this because i've spend the day seeing that everyone is receiving those notices of transfers and wanted to let u know to possibly try what I did. I'm not sure if my file was that ready to be worked, but the info I sent last Thursday got me out of them sending out an RFE...and we got approved. I hope this helps out...good luck to us all. I'm still waiting to receive my official NOA2 in the mail.

I still think the K3 pulls the I-130 along faster. They keep saying they are joined (Merged) and maybe thats not a bad thing.

Did the Senators office say anything about that? Other wise I'm pretty unhappy reading what they told you. Wow in 5 min. time, it goes from maybe maybe to oh no again. There are others contacting thier Senators office about the processing times for the K3. Maybe we'll hear a different story from those members.

I remember your Lawyer was in a hurry and spending his own time to file that for you. I'm not sure where (or how current) a Senators office would get this answer. Maybe its junk.

So cheer up LoveMyTico your doing every thing you can.

This person at the senators office was talking #######... almost like she is paid to hand off that line to everyone. I would rather go with REAL TIME status reports here rather than listen to someone who works for the government and rattles off a line or two to get me off her back....

'tK-3 gets merged, then at least they are looking at my file... The K-3 gets processed at a different service center... I don't know why so many people here are anti-K3. I am happy that I sent it out. If the CSC is working on Aug 2013 , then mine was just filed in Oct... that to me is better than waiting another 6 months OR MORE for the I-130. I couldn't care less about the adjustment fee. The most important thing is that he is here with me. I just ingore the K-3 haters !

Plus, like you said ... I hear so many people say they were told to file the K-3.. Its free.... I'm happy with my decision because I know I have done everything to speed this along

I don't t hink I would send anything that they didn't ask for.... just my opinion.

Since I did an infopass appt at my local field office, the woman I spoke to there told me to send it to that office, which is here in town for me in Des Moines, IA.

Did anyone tell you it's been transferred, but no paperwork? Becuase that's what happened to me.

I set up the appt, and met with one of the immigration officers/adjucators there.

I don't think that if this was still at NBC..that anyone would have told me this.

I went home after my infopass appt, and started going through my paperwork to show that we have a relationship because she told me the 2 affadavits I had would probably not be enough and if she was looking at it that she would give me an RFE...

I rushed home, gathered as much as I could to prove our relationship...like stated in my last post. I provided a copy of my initial receipt notice I received in February and I wrote a letter that included our names and receipt number and signed it. The letter stated to route all of the paperwork to my file. They received it on Friday, and we were approved on Monday.

I also didn't receive a notice it was transferred. I called USCIS myself and that's what I was told. My initial question for them at the Infopass appt was to confirm whether or not they had my file..or if I was lied to by a tier 2

Yes, no fee. Pls. read the instruction on I-129F. It is no charge for those who already filed and paid I-130. Good luck..

Lee's Summit is the NBC. That's so odd. Where was your file before this? It was my understanding that the files were being transferred FROM Lee's Summit to other service centers.... I'd call if I were you ! Let us know.

My case was at NBC, I called again today and got to speak to a Tier 2 who said my case was transferred to Nebraska Service Center.

Tier 2 officer from USCIS informed us yesterday that the processing time for i130 is now 16 months !!! because files are being moved to local offices due to backlogs in NBC.

As discussed in this post here, filing for I-129F could only be a possible option. Lets hope for the best.

yes, check Las Vegas field office what they're processing right now. I got same notices as you on the same dates too, but mine is here in CA. Goodluck...at least we know where they are right now and if we want to, we can now schedule an info pass to check the status of our case. I am so thankful to that Filipino Tier2 officer that I've talked to last Tuesday, he was so right and told me to file I129, which I did...
