Timeline

It's been 90 days so far - with no word other than the initial I-797. So, I called today and spoke with a tier 2 IO who informed me that my case was in the queue at the Dallas Field Office. I asked if he would expedite our case as my wife is living in a dangerous situation due to her government job, location and the unrest in Southern Thailand. He agreed that that might warrent an expedite but of course the decision isn't his. He submitted the request and advised me that someone would get back to me within the week. I have little hope that our case will be expedited but there is a slim chance. Maybe we'll be lucky...

November 27, 2012 - Married
February 01, 2013 - Mailed I-130 for wife and step kids
February 04, 2013 - Delivered to Phoenix Lock Box
February 08, 2013 - NOA1

May 28, 2013 - InfoPass at Dallas Field Office - Case assigned to an officer and now on her desk to be worked

June 01, 2013 - NOA2 for my wife but the kids had an RFE issued. (day 54 from NOA1)

June 01, 2013 - December 19, 2013 - Case "lost" at the Dallas Field Office
December 19, 2013 - mailed to NVC
January 08, 2014 - NVC received case
February 06, 2014 - NVC assigned case numbers

Same boat. My I130 is still at NBC. With no tentative completion schedule timeline. I went to infopass which was uselss the IO barely spoke English. I think if I spoke Spanish I could have gotten somewhere with him but it was just too painful to talk to him.

So I called the USCIS and asked wether my case had been transferred to a local field office. The Tier 2 rep told me it had not. Last week a tier 2 rep said the same thing that the case is still at NBC.

I received my NOA1 feb 27th, so it's been at the NBC for almost 2.5 months without a transfer.

Then the Tier 2 rep put in a service request. I was surprised because I didn't think that my case was eligible to have a service request put in. I think that maybe because the case hasn't been transferred was the reason. Anyway he said I should receive an update on my case by mail within the next 2 weeks.

I asked him what is the general timetable for NOA2 currently at NBC and he said right now it's at around 5 months.

My wife is visiting in the US in June for our honey moon. She is coming with a B1/B2 visa we filed the I-130 NOA 1 on Feb 20. We originally wrote for consular processing. Once our honey moon is over is it possible to change to permanent resident status when she is here on our honey moon?

My case is at the Dallas Field Office and I was mailed this update after my inquiry:

"Your case is currently in queue to be scheduled for an interview. An appointment notice will be mailed to the address on file."

Do they usually queue interviews at the local offices?

NBC replied to my email and wrote:

USCIS records show that your Form I-130 petition was received on February 25, 2013, and is currently pending at the National Benefits Center. We regret the time it is taking to process your Form I-130 petition. USCIS records show that the processing of this case has been delayed because the required USCIS review is still in process. Until the required review is completed, this agency cannot move forward on this case.

Please understand that the review is part of the process for adjudicating cases of a similar nature. While an exact date for completion of the review is not known at this time, USCIS will make every effort to make a decision on your case as soon as the review is completed. Additionally, USCIS will not grant a request to expedite while a case is under review.

We trust that this information is helpful.

Did anyone get a similar message? What does required review mean? I am filing from abroad (Canada).

We have been so blessed! Our senators office has been tracking the application for us, and even though they can't 'help' in any way, I'm sure it did help!!

We were transferred after about 1.5 months to the Philadelphia field office, and got our approval today :) off to the NVC, and it's about to get a whole lot more complicated!!!!

Hi All I filled on february for Wife and 2 daughters, priority date is 02/01/2013, Got NOA2 approving on 04/17/2013 , been calling the NVC for the last 2 weeks, and sent the email to nvcresearch on day 15th as advised by the NVC rep 4 days ago.

Today I called USCIS and they transferred to an Immigration officer, after 1 Hour and 36 Minutes on HOLD a super rude agent picked up, he asked for my address, name and DOB and said my files were still with the officer in charge of the case, haven't even left USCIS. I told him what was the delay that the note I received almost a month ago clearly said "Petition approved and forwarded to the NVC" all he said was that it can take up to 4 months to leave USCIS even if i receive that letter and that all i could do was wait and almost hung up on me.

It's ridiculous that a petition approved a month ago is still sitting on a desk and all they have to say is wait and that there is nothing they can do.

How can I proceed anything I can do?

I would very strongly advise that you get in contact with your senators office. Ask them to enquire on your behalf and explain the issues you have been having so far, they will be happy to help you. We asked at our senators office when our I-130 was taking much longer than those with the exact same time lines(sent in feb, moved to Philadelphia etc) and I asked my husband to contact them because I was concerned that they're may have been an issue with our application.

There was no issue, but it was just approved on Tuesday. The woman in the senators office said that if we haven't received our NVC case number within 3 weeks we should contact her to follow it up.

I hope that doing this will help you to achieve some clarity and possibly some swiftness in your case!
