Hello VJ!

I am writing this on behalf of my brother, as I am the one who will be handling all his paperwork.

My brother met his Mexican citizen fiance in Mexico in 2009 and in 2011 they had my nephew who was born in Mexico. My brother is petitioning for a K-1 visa for his fiance and I am up to date on what we need for her. The problem lies with my nephew, as I am confused as to whether we should proceed for an 1-30 visa? seeing as his father is a natural born U.S Citizen.

Any advice we be appreciated! Thanks in Advance!

Look into what the your brother need to do to register his son as a us citizen at the embassy, he won't need a visa.

My sons AOS and IV bill paid March 23rd (status in progress)
My sons AOS and IV bill shows as paid March 26
My IV bill paid March 26
Both packages sent on March 26
My IV bill shows as paid on March 27th

The child is a US citizen. He needs to have his foreign birth registered with the US Embassy/Consulate and request a US passport.

Like any other US citizen, he can enter the US with just his US passport.

Do not file an I-130. A US citizen does not need a I-140.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
