Hi VJers,

I am US citizen applying for my alien mother to immigrate to USA. What is the maximum age of her unmarried children who can accompany with her? is it 21 years? I had heard that USCIS had raised the age limit of unmarried children who can accompany a parent to 25 years of age. Is that true? I wasn't able to find any information regarding maximum age from i-130 form instructions while applying for a parent.

I hate to break it to you, but you are operating on bad information. The answer is zero! If you petition a parent, they don't get to bring their kids with them, sorry! Sure, you can file a separate I-130 for you siblings, but I'm pretty sure the waiting period will be years if not decades.

What you heard is wrong.

When a USC petitions for a parent, only the parent qualifies for a visa. No spouse and no children will receive any benefits.

what you guys are saying is that if USC petitions a parent, only the parent qualifies for family based immigration visa... Not their spouse or dependent childeren under 21 years of age???

but if USC petitions a sibling, their spouse and dependent children qualify?

The reason why i am making this distinction is because that's how my family immigrated to US. The USC sibling filed for his brothers and sisters, and their spouses and depedents get to come along for a ride.... Has USCIS stopped this now?

I guess if the child is in uterus that would be OK.

For parents you would file for each one individually.

The primary function of immigration is to separate you from your money. So if there is a path for you to apply for someone they usually are denied a free ride through someone else. You can apply for siblings so they can't ride along with your parents, you can apply for a parent so they must each have a petition. You can't apply for your brother in law or nieces/nephews so they get a free ride on the sibling petition. You can apply for a step chld so they don't get a free ride with a spouse. Just think the path that makes USCIS the most money and that is usually the answer.

This will not be over quickly. You will not enjoy this.

The rules are different when a USC petitions a parent versus a sibling. The rules have not changed. You just lack understanding.

When a USC petitions a parent, it is an Immediate Relative case where there are no visa limits which means minimum waiting for a visa. Usually the parent gets a visa in. 6-12 months. Since this is an Immediate Relative case, only the parent qualifies for a visa. No spouse and no children are eligible for visas.

When a USC petitions a sibling, it is an F-4 family preference category case where visas are limited which mean waiting 12-23 years. In the F-4 category, a spouse and unmarried children under 21 are eligible for visas.
