90-day temporary work authorization at POE

Hi, I am a K-1 visa holder traveling to the US in March. Our wedding is in April, but I would like to look for employment as soon as possible. I read that the EAD application is filed alongside the AOS, which takes place AFTER the marriage, but I also read about a 90-day work authorization issued at POE. How true is this, is this still being done?

I am (usually) the beneficiary.

The stamp is still being given at me POE's but it shouldn't be because it's not valid for employment. So even if you DID get a stamp, you couldn't use it (see the i-9 which you need to complete to accept employment, and it's not listed)

You can file for EAD before you file for AOS but you need to pay for it, and it's only valid until your I-94 expires (i.e. 90 days). it takes about 60 days to arrive so it's a big waste of money.

is a List A document, and I have this.

You have a K-1 visa, a non-immigrant visa.

CR1, IR1, IR5 are immigrant visas and turn into temporary green card (I-551) upon processing at POE.

You really picked a wrong visa if you wanted to work as soon as you enter the US. Now you have to get married and file AOS asap if you want to get an EAD fast.

A K-1 visa does not get you an I-551 stamp.

An I-551 stamp is a green card.

You do not get a green card automatically when you enter the US. So, you do not have a foreign passport with an I-551 stamp.

is a List A document, and I have this.

That's a GC stamp, not an EAD stamp. The EAD stamp was (many many years ago) temporary work authorisation, it's not been legal to use for many years, but it's still sometimes given out and people think they can use it. The i-551 stamp is not given to K1 entrants.

If your wedding would be on April...then that would be the time u can process ur AOS to get a green card as well the AP and EAD after ur wedding. With regards to the 90 day work authorization, IT DOESNT WORK esp if ur applying in big companies. Getting a work here in US is not easy as u think, just try to be more patience until u got ur green card...focuse on ur wedding, then AOS application to get green card and upon approval, that would be the time to think about working...make sure to apply MANY COMPANIES AS YOU CAN ..goodluck

I will just wait have to do something else for 2 months I guess. I hope I don't go nuts from boredom. Maybe I will learn Spanish through YouTube... :)

I have a question though, it says a combination of List B and List C will be accepted. Hypothetically, while someone is waiting for EAD after AOS, they can enroll in a community college and apply for an SSN. Can they present their School ID card with a photograph (List B) and SSN card (List C) to an employer?

No. You are not authorized to work. Period.

Accept your situation.

While I applaud your creativity, you're just going to get yourself into trouble.

Spend your time learning Spanish on YouTube. Go out and make friends. Learn about your new country. Do anything you want except work.

However, I don't understand how my follow-up inquiry would not be acceptable. Can you see specific reasons why it would not work? For example, the SSN issued to K-1's before AOS would be restricted or something? Why would they still issue the temporary work authorization to ineligible people at POE if it was completely unusable?

Exactly. The SS card given out to K-1 holders is restricted. It states "valid for work only with DHS work authorization" or something similar. The work authorization is the employment authorization card which you can get once you get married, you apply for it along with your adjustment of status application (green card application). The employment authorization card will arrive in about 60 to 90 days after you apply. Once you get a green card you can apply for a new SS card with the authorization removed (it will be the same number, just a different card). Then you will be able to fill in the I-9 with documents from list B and list C.

It is possible to apply for an employment authorization card as soon as you enter the US on your K-1. However it takes about 60 to 90 days to arrive, and will expire when your I-94 expires (90 days after entry) so it is a complete waste of time and money. The employment authorization card you apply for with your adjustment of status application is free.
