Timeline

Well I have not filed yet, I'm just trying to get myself prepared because I dont plan on using a lawyer. We are planning on getting married Oct. 2013. small wedding, nothing fancy. I am just so nervous because I have already petitioned for my ex-husband in 2003 but he got arrested before the 2yrs was up to lift conditional residence status and lost his green card. We are legally divorced now. So, I met this guy and love him dearly and want to marry him but I'm afraid it will be a lot harder to petition him. I dont want want them to think I'm just marrying to get immigrants their green cards. Also there is about an 8 year age difference. I am older but you wouldn't even know by just looking at us. He looks and acts older than what he really is. Any advice? Is there anyone that has been through the same situation?

There is no need to hire a lawyer as long as you have a straightforward case, most members here have never used a lawyer. I am 21 years older than my husband and we navigated the process with little to no problems, he is here in the US with me now. Lawyers are a waste of money if you have a straightforward case, in many cases they delay the process. If you follow the guides posted here you should be able to do it yourself. Good luck.

How long have you been divorced? You say that you applied for your former husband in 2003 and that he got arrested before his two year removal of conditions deadline and lost his card. Did you divorce soon after? If a reasonable amount of time has passed, then there shouldn't be much of a problem. You have the right as a USC to petition for your spouse as long as you can prove a bona fide relationship exists, but if you file back-to-back applications, you may throw up a red flag.
