how will I be able to get an ITIN for my wife? will she have to sign the papers and what else do I need with the W-7? copy of her passport? birth certificate? marriage certificate?

Coming out of China -

she needs a notarized copy of the BIO page of her passport, notarized by a Vice Consul at a US Embassy or US Consulate in China.

So, start there, get her an ACS appointment at the Consulate/Embassy of your choice. She'll need 50 bucks usd or local equivalent.

Then

have her sign a W-7 document

have her sign the 1040

have her sign a letter to the IRS, stating that the two of you are electing for her to be treated as a resident alien for tax purposes.

Then

She ships all of this to you (signed W-7, signed 1040, signed letter, stuff from the Vice Consul)

Then

once you receive it ,

you sign the 1040

you sign the letter

Then

You ship off all to the special w-7 address listed in the W-7 instructions.

Sorry, all is paper - expect a paper check back if getting a refund.

Married Filling Seperately is not a problem then changing to Married Filling Jointly. This is what I did, there is a huge difference if you don't need the money now.

Maybe a dumb question. But for the letter. do I just write

To whom it may concern?

and how long should the letter be?

so far I just have

"this is to state that ______ a US citizen and _____ a nonresident alien are electing ______ to be treated as a resident alien for tax purposes." is one sentence too short?

My wife and I are writing you to inform you that we are electing to have my wife - <<insert name here>> - considered as a resident alien for tax year 2012.

You could file an extension if you think she will arrive in the U.S. within a few months....once she does you should be able to get her SSN fairly quickly. That's what I will do. Just my $.02...

here's something about an extension, aye? if you think you'll get a refund when MFJ - file nothing till she gets here and has a SSN. Nothing at all. Then file a regular tax return (1040,1040EX, whatever) . There's no penalty if you are getting a refund, la.

Of course, the bad part for now? if you need to show the 1040 for TY2012 for NVC or IV - well, ya gotta file something, aye? There's another 3 months so odd days to go.
