I have filed an 1-130 for my husband's two daughters. My husband has been here less than a year. I have been on workman's comp since May of 2012 and will be for some time. Workman's comp income is not taxed, so it does not appear on the tax forms. Our income together for 2012 line seven was $31,000. However, we have the additional 16,464 from workmans comp. Prior to this I worked 15 years for the same company and have had an income far above the poverty level. I am in graduate school still have have been unable to do my previous job due to an injury on that job. Question: Since my husband is not the citizen does his income count? Is Workmans Comp considered proper income?
