hi everyone, I'm a us citizen living in poland and i've started the immigration process for my husband. This is our story:

march 2001 my husband came to the us first time

we got married in march 2004

our son, Mirek was born in November 2004

in August 2006 I came to poland with my son and mother in law

in october 2007 my husband came to poland

had a great time living here and teaching but starting to really miss the good'ol usa

december 2012 sent I130 petition to chicago lockbox

what i wanted to know is: if my husband overstayed on a tourist visa (from march 2001 to october 2007) how does the immigration process go? are there any additional documents/forms that i have to file? if anyone has any info about this i'd be very thiankful :)

Because he overstayed more than a year, he has a ten year ban, of which 5 years are already served. If you file now, he will be denied at interview due to the overstay ban. There is a waiver for that, but it may be difficult to get it because the overstay is lengthy and it seems you can live comfortably in Poland.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
