Tax information for February NVC filers 2013

Hi everyone,

I am really interested to know about the tax information that 2013 NVC filers should include in AOS (I-864) packet.

Should we include tax returns for the last 3 years? (2010,2011,2012)

Basically, should i wait for my 2012 tax return to be processed ?

in order to be able to include Tax transcript from IRS for 2012 ?

No, don't wait. Usually NVC/consulate won't ask for taxes until past the April 15 deadline for filing taxes. So you would send 2009, 10 and 11 with the AOS packet. Don't hold up the AOS packet b/c you need to get transcripts from IRS. BUT make sure you have those transcripts, or at lest copies of your whole tax return, when it comes time for the interview, the CO might ask for it.

if the interview is past 15 April, be certain to have TY2012 tax return in yer spouse's hand on interview day.

is okay to slip a year at NVC, but must be 'current' at the IV Unit.

This is good to know. I was going to wait to send in the AOS after I sent in my wife's taxes. I'll know better now. I'll just make sure they are ready for the interview if after Apr 15th (probably will be after Apr 15th).

IF you're at NVC after April 15 (God forbid!!!) you'll have to send in 2012, 11 and 10 with the AOS.

My wife got her ITIN for TY2010, we've been using it ever since.

So yes, for TY2012, we're filing (again) as married filing jointly, using her ITIN and my SSN.

to submit ITIN for both of them ?

There were some changes in how IRS is handling ITIN Updated ITIN Procedure Changes Announced.

It is so confusing to understand

I would suggest contacting the IRS directly. I did and explained the situation. I spoke with about 4 people and the final person was the one with specialization in international taxes. She indicated that I don't need an ITIN for my husband, but should write the letters, "NRA" where it requests his SSN, to indicate that he is a non-resident alien. That's what I'm going with, because the ITIN will take longer than I have.

The ITIN is filed through the IRS and they are notoriously slow. I don't want to put off my taxes if I don't have to. Initially, we were going to get him an ITIN, but after I confirmed with the IRS that I wouldn't need it, I dropped it. I usually do my taxes in January, and if I had to wait until I received an ITIN, I might be cutting the filing deadline a little too close.

I think there is an advice to get tax transcripts for previous years (2009, 2010, 2011) and include your W2 for year 2012 will make it.

As far as, if interview is going to happen before April 15 that should be ok

However, if interview will happen after April 15 - you/your spouse may also indicate that you have filed for 2012 with ITIN, and did not get response back till now.

A notarized bio page of the passport, notarized by a Vice Consul at a US Embassy/Consulate, trumps all of those ID requirements in the W-7.

As i understand, we need US consulate to notarize the copy of passport bio page of my wife.

However, what about documents for my kid?

ps: as a document he has a birth-certificate in native language(not-English,

showing his birth place, and parents(me and my wife).

do i need to translate this birth-certificate document and notarize it at embassy as well?
