Mom has 2 marriages with no annulment

Hi everyone,

I am back with a big question.. I am preparing my mom's I-130 and got everything ready or so I thought.

My mom and dad had me when they were 15, 16 respectively, they did not live together then when I was 8 my mom got married to my step father and later took his last name with all of her IDs and paperworks. with the marriage contract.

When I checked my birth certificate it shows there is a marriage date. WOuld this be a problem?

Maybe not so much for your mom but your stepfather will never come. They will declare the marriage invalid ( unless your bio was dead by the time they married ) so there will be no petitionable relationship for you/your mother to him

This will not be over quickly. You will not enjoy this.

Request a copy of your mom and biological dad's marriage certificate at NSO.

If they were married, you'll get a copy of their MC. This will make mom's marriage to stepdad void (unless she filed for annulment for the 1st marriage). Although I doubt they were really married since 15 and 16 year olds are not qualify to marry but then again they could have claimed they were older. Just speculating here.

If they we're not married, you'll get a certificate of no record. This will prove mom's marriage to stepdad is legit. But, you will have to make a correction on your BC since they put a false date of marriage there.

I understand, my stepdad was ok with that., I was only concern with the marriage void what will happen to her "IDs?"

should I just send the I-130 wiht N/z on the previous spouse or blank?

thanks for your reply. My mom got a cenomar a few days ago and indeed she was married twice. One for my dad and one my step dad. Would they see the discrepancy? SHould it not be just about her being my mom? and not her status?

Your mom is not an issue. Your step dad may be the issue, as he is not your actual father. Interesting that your mom got married a 2nd time without an annulment from her 1st husband. Is her first husband still living?

I don't know an easy answer regarding your step dad.

I don't know an easy answer regarding your step dad.

my mom did nt think she was 15 when they had her sign a paper. not lved her first husband. My only concern here is my petition wiht my mom. i just don't want to have a problem with that.
