Hi guys,

My fiancee and I are awaiting our NOA2 for our K1. It is past the processing time limit so we thought we would get our congress member to make an inquiry on our behalf (thought it was worth a shot) After a couple of weeks we got a response back from her today saying that our petition is with an officer at present and we should receive a NOA within 45 days.

Does anyone know what this would mean? Does it mean our petition is with an officer and is being adjudicated on right now or just that they will get to it?

Also, she told us after approval it goes to NVC for 2 months of processing. Looking on people timelines I was under the impression it would only take a few weeks for this process. Does anyone know how long it takes at NVS?

Any insight on either of these questions or how to make sense of the wording USCIS use would be very much appreciated. Thanks so much everyone.

Your petition is with an officer and you should receive some sort of notice within 45 days. It can be an RFE if everything is not correct. It is response number 3 on the standard list. It means "do not call again" But by the time 45 days passes PLUS the length of time you already waited there is a very good chance you will have your RFE or NOA2 and not need to call.

There is no "processing time limit", they can take as long as needed. Guidleines and gaols are just that. They make the goals and they can change them. They frequently do.

Congressman can do nothing but make an inquiry UNLESS either USCIS has violated a law or acted grossly negligent. They have not.

NVC processing can take up to 2 months, usually 2 weeks or less. THEN to the consulate who can take 2-3 weeks to get it in the sysytem and THEN you make an appointment for an interview which varies from 1 week to 4-5 months, depending on the consulate.

Our time from NOA2 until visa in hand was 50% LONGER than waiting for the NOA2.

we ask help also for our congresswomen. then they responce that when they do the inquiry USCIS said that our paper is on the officer already who will adjucate it. wondering why if they will said same stories if you let your congressman do the call.... then soon we will hear something...so depressing..

it took us 5 days .. then what they said to our congresswomen is true. were hoping that we will hear something. its been 192 days already. an then as the vj procesing time they will process today july 23 filer. i hope we will hear good news. its so depressing.

It took ours about 2 weeks but I think it can vary depending on who your congressperson is.

I'm also JUly 23rd filer but uncer CSC. It's been 196 days for us and we haven't heard from our congressman yet. You are right, it's quite depressing.

I felt that way too once in awhile but I guess allwe can do is wait and pray for all of us waiting. :)

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
