Timeline

If someone came over on a VWP and the US authorized 90 days for the vacation visa but married before it expired and is just starting and sending out the first batch of paperwork tomorrow, is he allowed to work; either with an employer or for work/repairs done for friends for cash or check made out to me? Or should said person wait for a response from the I-765 to begin work?

He is not authorized to work until the EAD comes in (typically within 90 days of filing). If he tries to work despite not being authorized: At an actual employer he would have to fill out form I-9 on the day he starts work, and would find himself unable to do so without lying on that form (very bad idea). If he does some casual contracting or under-the-table work for friends, nothing really bad will happen; unauthorized work is automatically "forgiven" for a successful adjustment-of-status applicant. But he is still not allowed to do it, even if it will later be forgiven. Were these laws written by Catholics?

LOL, sounds like they did! Thanks again for your help! I will pay it forward after I finish this process so I can help others in the same situation I am in right now- utterly stressed and confused ha. So I will put 'NA' in the box and not allow him to work or do side work until the EAD arrives. (;

If you're referring to the I-94 box from your other thread, "None" is better than "N/A".
