At the beginning of the month I received an RFE to show more proof that we are living together. Since we don't own any property or cars, we don't rent, and we don't have bills together I've had to really dig around for stuff. So, I thought I'd run my list of things past everyone see what you guys think.

  • Copies of jointly filed tax return for 2012.
  • Copy of xxxxxx's 2010 W-2. (We only have one W-2 because he has been unable to find work and I'm self employed. I don't make enough to get a 1099. I've explained that in a letter. I sent them our joint taxes transcripts from 2010-2011 when we first filed, should I send the actual pages to them now or receipts? Or will sending the W-2 and our 2012 taxes be good?)
  • 5 Notarized affidavits from friends/neighbors and family.
  • Copy of Life Insurance Certif through my credit union. (This has a California addy on it since the account sends everything to a PO Box should I explain that in my letter or will it matter? My parents keep up with the PO Box and any mail I get there.)
  • Copies of bank statements going back 2 1/2 years from two different joint bank accounts.
  • Copies of bank cards to joint account.
  • One voided check from joint account.
  • Copies of about a year and half of Verizon Family Plan Bills.
  • Copy of medical bills with same addresses.
  • Several photos starting from the time I filed in June until now.

They asked for Driver's License or ID, we don't own a car so my husband doesn't have a license and a state ID was not required for his one job or our bank so we never looked into it. I've explained that in my letter as well.

Wait, you don't own property and you don't rent? Where do you live?

We live with family, their house is paid off and they take care of all the utilities. Our "rent" is basically helping them out since they're elderly and slowly failing health.

Initially I sent them

Jointly filed tax transcripts for 2010-2011.

Temp insurance policy spanning two years with ID cards.

Copies of 3 (one from each year) bank statements from two diff banks showing joint accounts. (In hindsight I should have sent more I suppose.)

A little over half a dozen photos.

Copies of letters and package slips showing same address. (though they didn't mention that as evidence I sent when I got the RFE it was ignored)

Copies of ticket stubs from traveling together.

I had been told by several people it was good enough, as others have been approved with about the same amount of evidence, but I guess not.

Package slips and letters are pretty useless - easily faked. It sounds like they want some official ID with an address on it. The W-2 and tax return should have your address on it.

Even though he does not drive but you still have to provide a state I'd. For state I'd you don't have to give any written or road test. When I got RFE they wanted Both the petitioner and the applicant ids which shows the same address. My wife also don't drive but she does have an I'd. They wrote in the bold letters that we need both personal id's.

We never had AOS, we filed DCF for CR-1. Once we moved I changed our address to this one once we knew for sure we wanted to stay here.

The cell plan is in my mom's name but we had them put each person's name next to the number and it shows they are all billed to this address.

The affidavit that I had signed from my family we're living with states they pay all the bills.

So the RFE is that they only asked for Driver License? Or they asked for documents that show you both share the same address?

They were asking for documents that show we are living together. The driver's license or ID was at the bottom of the list.

Even though he does not drive but you still have to provide a state I'd. For state I'd you don't have to give any written or road test. When I got RFE they wanted Both the petitioner and the applicant ids which shows the same address. My wife also don't drive but she does have an I'd. They wrote in the bold letters that we need both personal id's.

When they sent ours it was the last thing they listed. I tried to get him an ID earlier this month but the will not honor his extension letter. :/

Well asked DMV write a letter why can't they give your husband I'd if they deny writing a letter ask for there supervisor and talk to him/her. If they are able to give you a letter then send that letter to uscis explaining them why you didn't you send I'd with the paperwork. You can also try different office sometimes you get worse person but trust me your evidence is gud you have to send I'd with the paperwork

I sent a copy of my SSC showing the address. Maybe you could add that.

Even if you don't have a car or don't plan to drive, your husband can get a Learner's Permit. Your parents can add him on their Insurance plan (I don't think it costs much for a Learner's Permit). Try a different DMV office.

Exactly 5 months!!! No Interview. No RFE.

Strongest Evidence? My 8-year relationship and 3-year marriage to my husband.

If it does not show commitment, then I don't know what does...

I sent a copy of my SSC showing the address. Maybe you could add that.

Even if you don't have a car or don't plan to drive, your husband can get a Learner's Permit. Your parents can add him on their Insurance plan (I don't think it costs much for a Learner's Permit). Try a different DMV office.

Thanks for the idea on the SSC. I had totally forgotten about the tear off part. I've added that. We were FINALLY able to get an ID for him. I had to get a hold of the supervisor and after about an hour of typing stuff and trying to figure it all out he's got his temp ID.

Get state IDs, those have as much power (in terms of identification) as Driver Licences.

Talked to the supervisor and he didn't see any problems with it so we finally have an ID for him. He'd never actually heard of the letter before so we had to explain it.

It takes about two weeks to get the permanent one in the mail?

Well I meant the extension letter, he'd never heard of it before. So he was happy to learn something and we were happy to get the ID. lol
