My fiance and I are working on the K1 Visa. We received NOA1 on January 18.

I checkt my passport and its only valid till mid March 2014.

So I kinda started thinking what if I get approved before that. I mean everyone is kinda looking and comparing the timelines and so I thought, there might be a chance that we will be approved around November. I know its just guessing but "lets all hope for the best and a fast approval, right?". So I am from Germany and my passort needs to be valid till we get married and three months after that ( or am I wrong here?)

This leads me to my questions:

a) Do you think I should aplie for a new passport before Ill send my information to the embassy in Germany and before my interview. I will get my visa in my new passport. This passport would be valid 10 years.

But if I want my name changed in my passport Ill get a new one and I always have to travel with both of my passports. Because my visa will be in my "old" passport.

b) I wait and dont get a new passport. We get married, I aplie for a new passport in the US and get my name changed. But I also have to carry both around with me to travel ( because the Visa is in my "really old" passport.

c ) I get a new one before my interview. I get my name changed on my social security, drivers license etc. but not on my passport. I just have to travel under my maiden name to Germany (and other countries)

Or am I just really confused right now??

Hope someone can help

My passport had about the same validity when we were filing at the end of August. I decided to just get a new one , it took me 2 weeks and I did not want to worry about it later to be honest.

GC received on the 28th of February, 2014 - no interview, no additional RFE's

Divorced as of September, 2014

NOA1 for ROC 14 October, 2014

Life goes on, my ex-husband is a moron.

I can't answer all of your questions; however, with a little more than a year left of validity on your passport, and a requirement that your passport be valid for at least 6 months following the issue of the visa, I think that it needs to be renewed. I am not sure how long your country takes to process passport applications, but my advice as far as renewing it goes, would be to renew it in a couple of months (just make sure that you get the new passport prior to your interview). Good luck with your journey.

a) Do you think I should aplie for a new passport before Ill send my information to the embassy in Germany and before my interview. I will get my visa in my new passport. This passport would be valid 10 years.

You just need your passport to be valid six months at the time of the interview in order to be get the visa and a passport six months valid to be able to use it. So let's say, your passport expires in six months and you get the visa today. But you want to travel in three months, you might need a new passport and travel with both as the visa is valid no matter if the passport expires, you get a new passport and visas in old passport are valid until they expire.

So, just wait and yes get a new passport before booking the appointment for the interview so you have plenty of validity on it.

b) I wait and dont get a new passport. We get married, I aplie for a new passport in the US and get my name changed. But I also have to carry both around with me to travel ( because the Visa is in my "really old" passport.

But if I want my name changed in my passport Ill get a new one and I always have to travel with both of my passports. Because my visa will be in my "old" passport.

No because you change your name when you are married already, as you are applying for k1 you will get married in the usa, therefore you used already your visa. Your k1 visa is just valid for one entrance. so you come here and then the visa is useless, you can't use it anymore. WHen you apply for your Adjustment of status, include applications for EAD (work permit) and Advance parole (travel permit). If you apply for those at the same time, same addresses, you get a combo card. One card for both purposes. The Advance parole will be what you will use to re enter the country until your green card is issued! so it will be your passport and your advance parole or combo card that includes advance parole. So you will basically just travel with your new passport :)

When you change your name, idk about your country and the validity of your us marriage or the paperwork to make it valid or register it in your country so you might have your maiden name on your passport but with the Adjustment of status apply for everything with your married name (so the EAD/AP card will have your married name). So what I have seen is people carrying a copy of the marriage certificate and the passport with maiden name. Let's see who else answers to this as I am not a woman, didn't change my name lol. My wife took my name but she is the US citizen so for her to get a passport with her new name is really easy! as everything else is updated already.

c ) I get a new one before my interview. I get my name changed on my social security, drivers license etc. but not on my passport. I just have to travel under my maiden name to Germany (and other countries)

Yep, I answer this already (kinda) on the previous question. You travel with your AP/EAD or greencard with your married name and your passport with your maiden name and carry your copy of marriage certificate but let's see who else with more experience on this answers!

Good luck on your journey!
