Hello everybody,

I've recently married my American wife and now we've started with the paperwork for my visa. Right now I've got a question about the affidavit of support (AOS).

My wife just recently graduated college and has not had a job with income over the last few years, so her mom is doing the AOS. I'm guessing that her mom is 'the only joint sponsor' on the first part of the form. I'd like to know if my wife has to fill out an AOS too even though she hasn't had an income over the last few years.

Both, the petitioner and co-sponsor, should file a form I-864.

Take a look at the following website where you can work out whether the income is sufficient, http://www.uscis.gov...form/i-864p.pdf

My mother in law's income is plenty, so the requirements won't be a problem. What you're saying is that my wife should file a form I864 herself too with incomes of 0 for the 3 years? And then completely rely on her mom as the only joint sponsor?

Yes. The USC petitioner is always the primary sponsor, even if they have zero income. Your wife and her mother fill out their own separate I-864 forms and provide their most recent tax transcript, letter from employer and/or most recent pay stubs. If your wife did not file taxes for any of the last 3 years, she must provide a statement as to why she was not legally required to file. The joint sponsor also needs to provide proof of being a USC or LPR. Have a read through the I-864 instructions.
